Justice Delayed...

It's a complicated case, but three years complicated?

A complex climate lawsuit dating to former President George W. Bush's first term remains among the unfinished business on the docket of Supreme Court nominee Sonia Sotomayor.

At issue is a lawsuit filed by eight states, New York City and environmental groups against the nation's five largest electric utilities in 2004, alleging that the companies had created a public nuisance with greenhouse gas emissions that must be reduced to counteract the effects of global warming.

The panel heard oral arguments on June 7, 2006. Read the whole thing.

3 This will probably be yet another millstone to hang around her neck, along with Ricci v DiStefano.

She's probably hoping that she can have her court wait on a decision until she's confirmed, then recuse herself when it inevitably reaches the USSC. 

(No matter who wins that case, you KNOW the loser will appeal it because the environmentalists are litigious bastards while the utility companies won't let an expensive judgment against them go unchallenged.)

33 No word of lie, I worked on a case that spent a grand total of 22 years going up and down on appeals on various issues.  This became a wee bit of a problem when all of the witnesses started dying off.  So, yeah, I'm not really surprised to hear this.

i took my family on vacation to a North Korean Labor Camp for vacation a few years ago, they aren't all they are advertised to be.  Actually they suck pretty bad. Only 3 our of the five people in my family made it back after one week. Worst Vacation EVAH. I do not reccommend it.

 

But seriously, while i hate north korea, i don't really ever feel bad for journalists, specifically american journalists. they run around this country knowing no one can do anything to them because they are protected by the constitution, so when they go overseas they think they are untouchable too, and every once in a while they get a dose of reality.  Does that make me evil? Is it bad when I laughed at reporters who got badly wounded in Iraq covering a war they degraded and lied about on air all the time?  In this case I feel for the girls because they were covering a story that needs to be covered and that is the state of affairs in north korea.   But normally i don't care about reporters or what happens to them.

Let me see if I've got this straight.

Eight states and NYC sued five companies that provides electricity for those eight states and NYC. Companies that (I assume) pay taxes. And provide a necessary service to the good people of those states, namely keeping people from freezing to death in winter.

Soooo, the government is acting against the interests of the people? I would've thought that the government would be promoting something good for the constituents, like lower power bills.

Am I missing something here? Isn't our government supposed to be protecting us from this kind of legal harassment? And who will benefit from this lawsuit, and in what way?
