"Charge" indicates a criminal case, but the article doesn't mention indictment, U.S. Attorney, possible prison time, etc. And like everyone else I don't trust the MSM to get it right.

"Fraud" can be charged criminally or through a civil suit. I believe the SEC can bring an enforcement action for fraud which is civil in nature and it's not unusual for the U.S. Attorney to obtain an indictment involving the same facts, but the damn article doesn't make it clear. At least to me.

No, not with this. But Senator Dodd (D-Conn.) got an "AF" mortgage from Countrywide. These "AF" mortgages, so called by the letters they put on certain mortgage application forms, carried the best rates for the borrower. Really, really low rates; unrealistically low.

"AF" stands for Angelo's Friend, by the way.

A senator from any other party would be indicted on charges of corruption for allowing this. A Republican would have his reputation irreparably smeared just for knowing the guy.

I saw the thing from the SEC.  It said they had internal memos about loan perfomance in 2005.  That is crazy.  Being a former shareholder and employee I am a pretty shocked by the whole thing.  But Countrywide could not have been the only company that knew this was coming.  Wow.

80 Charlie Gasparino is on Kudlow throwing cold water on this.  He asid it is a civil case, which we knew, and that it will be settled out of court.  He said the water mark for insider trading is lower for a civil case than a criminal one so they may not have enough evidence for that.  Both kudlow and Gasparino have said this upsets them they know the guy but they have to discuss it.  Gasparino has said that the phrase "irrational exuberance" will come up as well as "the disclosure issue".  Interesting since he has been on leave to write a book and they bought him back to discuss this with kudlow.  so, to recap, Charlie, who is generally right, basically said there will be a slap on the wrist and a fine.
