Maine Drafts "People's Veto" Referendum on Marriage

This appears to be an attempt at evenhandedness (that's not sarcasm, I mean it):

"Do you want to reject the new law that lets same-sex couples marry and allows individuals and religious groups to refuse to perform these marriages?"

On May 6, Maine became the second state to legislatively allow gay marriages without a court order. The Maine marriage bill, like Vermont's and New Hampshire's contains religious conscience exemptions for churches and also explicitly provides that no person for any reason (religious or not) that is allowed to perform marriages can be forced to perform a marriage they don't want to.

Petitioners have until 60 days after the close of the legislative session (roughly mid-June) to collect 55,087 signatures. The marriage bill passed by the legislature is stayed until that time. If they manage to get the signatures, the stay continues through the election. If they don't get them, the stay expires.

Incidentally, Doctor Zero over at Hot Air's Greenroom had an extensive discussion of gay marriage (he's opposed) which I think makes good reading. If I ever have a free second again in my life, I intend to reply to several of the arguments he's making.

Oh, And While I'm Thinking About It: There was some expectation that the California Supreme Court Prop 8 decision would come down this week. That does not appear to be the case. The Court issues decisions on Mondays and Thursdays with one working day's notice in advance. Since there is no notice of incoming decision tomorrow, we can rule out a decision this week. Several commentators have suggested that the Cal Supremes will let the recent marrige events in Iowa and New England alter their decision.

I wouldn't call that evenhanded myself. Why is the word "reject" used? It's a blatant push, nobody likes rejection. Better terminology would be repeal or rescind. And it should have been "new law that replaces domestic partnership with marriage for same sex couples..." not "new law that lets same-sex couples marry...", that suggests there was nothing then this law.

2 Remember, we're supposed to not oppose gay marriage on religious basis because religious institutions would not be required to perform the ceremonies.  Its always included in the laws.  And we all know that government would never ever attempt to change a law.

That's standard phrasing for a people's veto question.  Last year, we vetoed a tax on soda and alcohol.  The question then was:

Do you want to reject the parts of a new law that change the method of funding Maine's Dirigo Health Program through charging health insurance companies a fixed fee on paid claims and adding taxes to malt liquor, wine and soft drinks?

I consider the added text to be very poor.  Throwing in that religious exemption stuff makes it read like that is the thing being eliminated, and could get people who would vote to remove gay marriage to vote to keep it because it sounds like its an attack on religion.

They have to include all of the language that was passed in the original law. The law actually amended Maine's existing marriage statute and added the religious exception.  That's what has to be vetoed - everything added.

That's the first thing that struck me. Presumably an informed voter would know otherwise, but where are you gonna find an informed voter these days?

My point is that in the case of people's veto questions in Maine, the 'do you reject' language is always used.  Veto: I forbid.  Doesn't matter whether the law vetoed is gay marriage, taxation or something else.  That's the language.

In Maine, the question in your example would have to be: Do you want to reject the language which codifies the definition of a marriage as a man and a woman...etc.  It has to veto the language in the specific legislation.

Including the language is fine.  But how its written seems awfully sneaky.  And the articles opening line indicates that they didn't have to write it up this way: "Maine election officials have drafted the question that will appear on the state referendum ballot..." There's got to be better phrasing to allow them to include everything that doesn't make it read like its removing the religious exemption from the law.
