| SCOTUS Stuff...Sessions To Lead GOP On Senate Judiciary. Sotomayor Not That Smart?First the good news...Sen. Jeff Sessions will replace cowardly turncoat Arlen Specter as the ranking Republican on the Senate Judiciary committee. For the official Ace of Spades HQ positions on Jeff Sessions, check out this post. Short version...he's just a mustache away from being as cool as John Bolton. As for the presumptive front runner to replace the lackluster David Souter, it turns out aside from a nifty bio, she may not be the brightest star in the liberal legal firmament. This isn't an attack from the right but a writer on the left in The New Republic.But despite the praise from some of her former clerks, and warm words from some of her Second Circuit colleagues, there are also many reservations about Sotomayor. Over the past few weeks, I've been talking to a range of people who have worked with her, nearly all of them former law clerks for other judges on the Second Circuit or former federal prosecutors in New York. Most are Democrats and all of them want President Obama to appoint a judicial star of the highest intellectual caliber who has the potential to change the direction of the court. Nearly all of them acknowledged that Sotomayor is a presumptive front-runner, but nearly none of them raved about her. They expressed questions about her temperament, her judicial craftsmanship, and most of all, her ability to provide an intellectual counterweight to the conservative justices, as well as a clear liberal alternative. ...Some former clerks and prosecutors expressed concerns about her command of technical legal details: In 2001, for example, a conservative colleague, Ralph Winter, included an unusual footnote in a case suggesting that an earlier opinion by Sotomayor might have inadvertently misstated the law in a way that misled litigants. The most controversial case in which Sotomayor participated is Ricci v. DeStefano, the explosive case involving affirmative action in the New Haven fire department, which is now being reviewed by the Supreme Court. A panel including Sotomayor ruled against the firefighters in a perfunctory unpublished opinion. This provoked Judge Cabranes, a fellow Clinton appointee, to object to the panel's opinion that contained "no reference whatsoever to the constitutional issues at the core of this case." (The extent of Sotomayor's involvement in the opinion itself is not publicly known.)There's always all sorts of whisper campaigns for and against Supreme Court candidates but the left knows they are going to get a solid vote. What they really want however is someone who can take Scalia and Roberts on toe to toe. Well, good luck with that. Anyone who has the intellectual heft to even think about being the left's Scalia likely has a long paper trail. Can Obama nominate someone like that and still hold on to Senators like Landreau, Lincoln, Nelson, Webb, Tester, etc? Even with a filibuster proof majority life isn't all skittles and beer. Comments1

I read that TNR article. Found it amusing that the left also commits journalistic malpractice on one of their own.
Jeffrey Rosen ends the article with (paraphrase) "I have not read enough of her opinions to know if she's smart or not, but that's what I'm hearing." Gee, you dumb motherfucker, don't you think you should read her opinions before deciding whether or not she's smart enough to be on the Supreme Court. Sotomayor is just like Obambi - an affirmative action graduate who hasn't the brain God gave a pet rock. Even Bill Clinton's handpicked SCOTUS token, Ruth "Buzzy" Ginsberg is smarter by a magnitude of 10 over her. And, with Biden in the VP's chair hasn't this administration already filled its quota of stupid.

Hopefully, there are many conservatives who'll do some heavy lifting uncovering each and every decision from whoever it is that Bambi nominates and putting them through the intellectual wringer, looking for that all-important element of nuance. What they really should be looking for is any reference to foreign law or a mention of the Consitiution being that "living, breathing" thing. Either one of those two ideas should be grounds for disqualification, but that's just me. It does my heart good that one of my cousins from the great state of Alabama is now the head of the Judiciary Committee. We're all related, you know. In fact, an important legal decision was recently rendered by the Alabama Supreme Court. The question before the Court was: if a man divorces his wife, are they still considered brother and sister? Over the past few weeks, I've been talking to a range of people who have worked with her... Wait a second, I mean I understand that it was a forgone conclusion that some Supremes would be leaving the court and Obama would get to appoint new justices, but why was this journolist already talking to people a few weeks ago when Souter's retirement was just announced the end of last week? Also, in one of the comments above it sounds like others have been campaigning for a month about who to appoint. I think this begs the question, how long has Obama, the Democrats, and Journolist/dinner club, known Souter was retiring and did they collaborate on keeping it quiet until an advantageous time for Obama? I read it as she doesn't always conform to leftist thinking thus she must be an intellectual lightweight. Any decision that even butts up against conservative thought is considered intellectually lacking according to the left. I am now rooting for Sotomayer.

That alone makes bush's presidency a success. And the opportunity we're missing here is tremendous. A single lousy more vote on that court and we'd have been making some significant progress in this country. The good news is that Obama can only replace assholes with assholes, but the bad news is that he will appoint people who have another 40 years to live. Plus, the key to political power is always majority status. The majority gets to set the legislative agenda, and chair all the various commitees and subcommittees. Just to worry everyone else, we can also expect Stevens and Ginsberg to retire/resign before very much longer. Stevens is the oldest member of the Court (at 89) and Ginsberg is not only the 2nd oldest (at 76), but she is also suffering from cancer (pancreatic, IIRC). I imagine Breyer (71 this year) would also think long and hard about retiring before October 2011, in case a Republican wins in '12 and forces him to hang on until he's almost 80 years old...

Bush 1 had been assured that Souter was a conservative by New Hampshire Republicans, like his chief of staff. Turns out he was a pig in a poke. Roberts is the cChief jJustice of the Supreme Court United States. FIFY. I took a class on the history of the Court taught by Roberts's former boss, the late Chief Justice Rehnquist. Rehnquist was obsessed with protocol to the point of utter ridiculousness (to wit, the stripes he added to the the CJ's robes, based on those of the Lord Chancellor in Iolanthe). However, a point of protocol he made that was not pedantry was that while the Associate Justices are "of the Supreme Court," the Chief Justice is "of the United States," because his duties are not limited to running the Supreme Court: he is the head of the entire federal judicial branch. As ex officio chair of the Judicial Conference of the United States he arguably exercises more real power off the Court than as first among equals on it. Honestly, I think in the grand scheme of things having Sotomayor on the Court may be for the best.

If the left were to find a candidate as intelligent as Scalia or Roberts then there would be no chance that he would vote the way they want him to vote. They have to have an addlepated moron the likes of Ruthie to get the kind of service they want.
Sotomayor is the front runner given she has already stated in public that the role of the court is to make policy. She has breasts, she is a Hipanic and she has no conception of the role relegated to the judiciary in our country. She is thus the perfect candidate.
