| Individuals, Group Sue DHS Over "Rightwing Extremist" ReportThe Thomas Moore Law Center has sued the Department of Homeland Security because of the "Rightwing Extremists" intelligence assessment released last week. The suit is filed on behalf of a pro-life group, an Iraq war veteran, and Michael Savage. All three allege First and Fifth Amendment violations. According to their allegations, the report has a "chilling effect" on protected political speech and subjects them to unequal treatment because of their political beliefs or veteran status. They seek a declaratory judgment, an injunction, and attorney's fees. The fairly short complaint is here (PDF). Professor Orin Kerr is already making fun of it, calling it a "frivolous" lawsuit. (Attorneys can be sanctioned for filing frivolous suits.) Kerr characterizes the suit:As I read it, the lawsuit is claiming that the issuance of a government report criticizing certain groups violates the plaintiffs' constitutional rights. But the Constitution doesn't provide a constitutional right to have the government not say things that might be considered criticism. Perhaps the plaintiffs want the Constitution to be radically reinterpreted by activist judges to invent some brand-new constitutional rights?I can only imagine that he hasn't actually read the report and fell for the lefty drivel trying to explain it away. A copy is linked from here. It doesn't merely criticize individuals or groups. It classifies individuals as susceptible to or aiding in the creation of violent criminals and that classification is based on political beliefs. In particular, the report identifies support for state and local government, the Second Amendment, border security, unborn children, and several other conservative issues as fostering violence. It makes generalized reference to "hate-groups" that, in context, refers to conservatives. More than that--and this is the kicker--it does not merely focus on identifying, isolating, and preventing violence. That is something we can all agree is the proper job of government and there is, of course, no constitutional protection for committing violent crimes. Rather, the report specifically labels speech, conservative speech, as an activity of extremists. It then goes on to encourage law enforcement and other agencies to report "suspicious or criminal" activity to DHS or the FBI. A plausible explanation is that DHS is surveilling conservative groups and encouraging law enforcement to do the same. So, no, I don't believe it is a frivolous lawsuit. Perhaps if, as Kerr apparently assumed, the report merely criticized "rightwing" groups and perhaps if it hadn't included a call to action. This is not to say that it the lawsuit is without its problems. Though it is clearly not frivolous, it may not prevail on the merits. I'm not convinced that the plaintiffs have sufficiently alleged an injury caused by the report. Thus, as regularly seems to be the case around here, the first major hurdle for plaintiffs will be standing. Bombshell Update: Stick this in your hole and smoke it! The DHS civil rights division (DHS has a civil rights division?) apparently raised concerns about the report. The department decided to issue it before those concerns were resolved. Hmm, the fevered conspiracy-mongering that this was released last week as a preemptive strike at the teaparties doesn't seem as unlikely now. Discovery is gonna be a bitch. Comments1

I want to see who came up with the report, who wrote it and what did they base their info on? If Zero can release memos on interrogation for our enemies to read then releasing who authored this report should be no problem. I think DHS lifted info from the frothing lefty Southern Poverty Law Center ($PLC).

The recent report from the Department of Homeland Security and Big Sis Janet Napolitano goes even further. It ends on an ominous note. It says, “DHS … will be working with its state and local partners over the next several months to ascertain with greater regional specificity the rise in rightwing extremist activity in the United States, with a particular emphasis on the political, economic, and social factors that drive rightwing extremist radicalization. This isn’t change we can believe in. This is Janet Reno on steroids. Political Aids. I hope they win this lawsuit.

I'm glad that Fox and Drudge and other websites and bloggers exposed this DHS "memo" ... and that it got enough attention to cause Napolitano to have to publicly offer an apology.... Even the Communist ACLU has responded to some of these reports by saying that it crosses the line and shows a disregard for civil liberties. So dissidents on the left and dissidents on the right agree for once. But the government media complex, the Obama crowd, seems to be just fine with the idea of sending you up the river if you support a third party or oppose gay marriage. Considering Big Sister specified in a footnote that persons holding just ONE of the outlined beliefs, not some or all, but just ONE, is a potential threat? As I said in a previous thread, the head of the United States Department of Homeland Security essentially declared war on roughly half of the citizens of the United States. This political hack-attack is blowing up in their faces (does that count as a threat?) and is having the OPPOSITE affect then was their intention, I think. Doubtless they expected folks to be too intimidated to attend the TEA parties by the 'leak' of this memo beforehand. Now it's getting more and more traction as people become aware of it's stench. It's just a matter of time before they come after AoS, RS, etc., as "extremist, terrorist abetting" web sites. Be prepared.

For those who slept through World History 101...... here is a condensed version.
Humans originally existed as members of small bands of nomadic hunters/gatherers. They lived on deer in the mountains during the summer and would go to the coast and live on fish and lobster in the winter. The two most important events in all of history were: 1. Other men who were weaker and less skilled at hunting learned to live off the conservatives by showing up for the nightly BBQ's and doing the sewing, fetching, and hair dressing. This was the beginning of the Liberal movement. Some of these liberal men eventually evolved into women. The rest became known as girlie-men. Some noteworthy liberal achievements include the domestication of cats, the invention of group therapy and group hugs, the evolution of the Hollywood actor, and the concept of Democratic voting to decide how to divide all the meat and beer that conservatives provided. Over the years, Conservatives came to be symbolized by the largest, most powerful land animal on earth, the elephant. Liberals are symbolized by the jackass. Modern liberals like imported beer (with lime added), but most prefer white wine or imported bottled water. They eat raw fish but like their beef well done. The parts of the report that are picked up by the "rightwing" blogs, aren't from the text itself, but from the appendice's that are supposed to specificaly define wording.
The definition is in essence "anyone who didn't vote for, or regrets voting for obama." I remember doing paper work as a fucking inventory clerk, and I would have to hunt down the definitions for words that were used vaguely in the text of an manual on how to maintain a FUCKING INVENTORY! This is clearly a "no call" paper, as it's written, meaning, "I'm not saying you SHOULD investigate people who didn't vote for or disagree with, but I'm not saying you shouldn't, I'm not making that call." Classic bureaucratic bullshit. The uppers always try to tangle up the lowers into a mess of vague language, prime example? The "Fire no fire" on the pirates. Since the "fire" worked, there is no outrage for ignoring the "no fire." If there was "no fire" and the captain died, it would have been the commander on scenes fault for ignoring the vague and meaningless language that allowed for the "fire." If the fire had gone wrong, then the president is blameless, because he really said nothing. . . . .kinda like everything else he said. Classic no call bullshit. In my day job, I'm a member of an organization that participates with the FBI to share intelligence on infrastructure threats. My own occupation is involved in assessing the threat to a global financial corporation from all vectors that put our information and information systems at risk.
Having seen this remarkably political and incredibly sloppy analysis work put out by DHS, I am deeply troubled. I can share that many in my profession are equally horrified by this garbage that is a disgrace to the intelligence community. Besides obsessing over the parties that clearly are not a threat, it pulls the focus off of the real threats. We deal with them daily (it would surprise some here that entities like Hamas are actively at war with our information infrastructure as there is great profit in stealing financial information) and many of us are fearful that under the new leadership of DHS Director Napolitano, we are actually far worse off in ignoring real threats, creating politically correct barriers on consideration of real threats, and wasting intelligent assets on chasing nuisances. The lessons of 9/11 have clearly been forgotten. Incidentally, I am exceptionally critical of DHS's continued Barney Fief bungling over Timothy McVeigh. McVeigh's manifesto is almost indistinguishable from the positions advocated by Jesse MacBeth, Scott Beauchamp, Cindy Sheehan and the rest of the far-left radicals. That McVeigh used bombs should remind one of leftist and Obama best-friends-for-life Bill Ayers, not any nut on the right. That McVeigh liked guns should remind one of Che or Castro, not the right. That McVeigh hated the government should remind one of Obama mentor and philosophical teacher, Saul Alinsky. Get the damn profiling fixed, FBI and DHS. You have damaged your credibility in the eyes of professionals you work with daily to fight real criminals and terrorists. Step up, set your damn politics aside and do your job. If you can't do that and politics is too enticing, then quit. You have a conflict of interest we're calling you on the carpet for that precludes your capacity to serve this nation. If you fail to straighten yourselves up, another 9/11 will happen and I assure you, that blood will be on your hands. You won't be able to sweep it under the carpet of congressional hearings led by Jamie Gorelick and friends who we know were greatly responsible for the errors the first time around. The second time, the agency itself is implicated. Get rid of the politics. If Napolitano is too much of a crony, then resign in protest. Your first duty is to protect this nation. Druid/60: I really don't know yet. We were talking about it today internally and my counterpart that works with the secret service and FBI on a regular basis regarding investigations sent the report to me along with scathing comments. Initial impressions is that this is a political hit job by Napolitano - it was very poorly constructed, hardly researched and looks like the product a junior college freshman might do, compared to what the agency should be able to produce given its expertise and resources. Perhaps she's trying to earn the respect of her boss, but as we learned from Gorelick's similar efforts, she created the intelligence breakdown that ensured 9/11 would occur. This effort by Napolitano can have the same effect if it redirects agency resources off of left-wing radicals and onto benign fools (or worse, citizens angered by government corruption and irresponsibility).
I'm looking forward to learning how our field agent contacts feel about this piece. Hopefully they will disassociate with it as well, but when it's a directive by the DHS director, disassociation may have a professional price. Napolitano has to go. She's got the "politics first, last and always" aspect of Reno without any of the competence, and it's clear she's an eager beaver to show her boss how loyal she is. And incidentally, there is one other theory for those that are a little more conspiratorial than I'd like to be this early in the administration:
Napolitano was instructed/directed to get the heat off of the left-wing anarchists and radicals like ANSWER, La Raza, ACORN, ALF and ELF and all the other violent extremists out there. In addition to the "stimulus" bill sending billions to many of these entities (e.g. ACORN's upcoming role in the Census), the message to DHS agencies to lay off the left and refocus on the right needed to be sent. In that light, the report was a DHS Targeting Manifesto, mostly focused in backing off the left and shifting to the right. The continued classification of McVeigh as a "right-wing radical" is a curious one. Bill Ayers carried out his anti-government terrorism, bombings and such, starting while a Democratic president was in office. How is it that we don't consider him as a "right-wing terrorist" since the hatred that fueled his terrorism against this nation started under President Johnson? Worse yet, Ayers and the Weather Underground were in opposition to Vietnam and Laos intervention -- but who started that war? Not a Republican, but Democratic President Kennedy. The news media (and apparently our politicized intelligence agencies) forget that to the radicals, neither party is acceptable. Kennedy and Johnson were useful fools at best to most of the 60s and 70s radicals -- less hated than the right only because the radicals could always manipulate them for some short term gain. Curiously, they've done it again. They elected a President who believes he can control them, and according to some, the President has directed the DHS director to call off the agencies from any further investigation of the radicals and anarchists. He believes he can appease them by having her focus on the imaginary "right-wing radicals" like all those options traders in Chicago and the bankers in rural Nebraska who went to a rally to oppose government corruption. The pressure has to be put on the agency now, before these efforts to give stealth and immunity to the real terrorists within our borders sets in. It takes more than a half hour of national or local news to be truly informed of current events. The pablum and party line spewed by the main stream media belies how much has changed and is being changed in less than 100 days of Obama's administration. Think about what has transpired in less than 100 days. Many who were tapped for this administration didn't make the cut for legal reasons. 100 IllTempered... I'm no DHS, but a strategic IT risk expert for a global financial corporation (not one of the bailout types, btw). So there's no fear of a witch hunt. I'm also open in my critique of DHS - if our nation is one that no longer accepts the concerns of all of us who are in the best position to correct what is wrong, then it has greater things to worry about.
That said, there is one final thought that I realized has me madder than hell tonight about this damn political garbage: finite resources require focus. What I mean here is this: my employer is someone you deal with every damn day of your life as you buy stuff. We're one of the big players in the "the Internet of finance" - that's about as specific as I should get. Even as big as we are, we have to focus on the threats we deal with. While we look at IT and information security threats, for example, it all comes back to finance and risk management in making the best decisions on what threats to focus on, and what we think we can not worry about so much. For instance, we could put a $300K firewall in front of every server so we reduce the risk of a compromised server being a jump-point to another system on a shared segment. But by spending several hundred million to do that, we'll have to take that money from some place else. We expand focus on one area at the expense of losing it on another. Every action has a cost. Napolitano has ordered DHS and its agencies to place focus on people who are opposed to illegal immigration, people who are concerned about corrupt governments and financial excess along with the usual wackos like the rare klansman and other folks in need of institutional placement. The real problem is that she's demanding focus on a very large population as she defines most of the libertarians and conservatives as "persons of interest." This will take agency resource to shift focus, at the expense of not tracking other threats. So, another 9/11 happens because we were tracking a banker in Cozad Nebraska who was upset that his tax money was being spent to enrich another DNC donor, or a Texas small businessman who lost a critical contracting job to a firm that uses illegals. Simply put, even the US Federal Government and DHS doesn't have infinite resources. It must focus. What Napolitano has done is spend all of that focus on people who simply are not likely to represent any real threat, at the expense of letting through those who will kill us. In my world, the world of risk management, Napolitano has already killed a fraction of your children and family. The math's already done per her decision, as probably directed by President Obama. Each of you reading this should look at your wife/husband and children tonight and realize this: 0.002 of them is dead. They were killed by this report because it directed the agency's resources on non-threats, at the expense of the real ones. Hopefully for you won't be one who realizes the full integer (since life/death doesn't happen in fractions like we risk managers use), but some of you will. Please remember my post when it occurs so we can hold the right people accountable. If Obama fires Napolitano and corrects this mis-use and mis-direction, we can reduce the blame on our President should it happen and once again have a Gorelick situation where our agencies let us down. But if he doesn't, then you know who is to blame. Finite resources demand focus on the likely threats. To do otherwise is to choose to let the real threats succeed. Napolitano was our Gov for 6 years and she is a jerk. She jumped for Barack early and often. When she was appointed to DHS I said good riddance, little knowing she would again emerge as a threat at the Federal level. 123/sickinmass: Yea, we got a tour of the Omaha fusion center before it opened up. If used correctly, it should be a good resource. You'd be surprised how the ineptness of local law enforcement can complicate things. Then again, if used improperly, they'll be a problem. Classic centralization risk.
We all need to really crank up the pressure on the USFG now. I finished Georgio Agamben's "State of Exception" last week and it's really disturbing to see how many dictators didn't seize power, but rather were provided it and utilized the state of exception to expand into their extra-constitutional authority. We need to be absolutely objective and realize that we allowed Bush to do this with TARP last fall and the creation of the extra-legal status for Guantanamo detainees. I hate the bastards and think they should have been interrogated and shot, but we have to be critical of what our President did respective to what was authorized constitutionally if we're to ever get out of this mess. Agamben points out that apparently Thomas Jefferson noted in a private letter that the Louisiana Purchase would never be considered constitutional. He figured it was a deal too good to pass up, since Napoleon was really in a bad situation, and if Americans wanted to hate him for it later, they could throw him out. Meanwhile, they had a great gift. Lincoln, Wilson, FDR, Kennedy, Johnson, Bush and Obama all have exploited the state of exception. So, crank up the pressure. Napolitano needs to resign or be fired. There needs to be a ton of noise that keeps cranking up until she's gone. Otherwise, I think we all know how DHS's incorrect focus of resources will eventually catch up with us. It is interesting how much the left has managed to distract us since 9/11 from the real and ongoing threat of radical Islam. When you read down into the story you note several things. First, they somehow managed to bypass all the lower courts and go straight to the State Supreme Court. Second, she is being represented by lawyer Dick Harpootlian who is the former SC Dem Chairman.
They maintain that it “hurts SC education” to not take the money. I am waiting for someone to remind them that the “education stimulus” can only be used for hiring “new” teachers and principles in “economically disadvantaged” school. Since SC now funds schools with property tax and Columbia schools have NEVER been economically disadvantaged this case doesn’t have a leg to stand on.

The implied context of that DHS document that I could be a threat to the Republic, and the Constitution [which I personally view as utterly inseparable...], after swearing an oath of loyalty to same, an insufferable insult. You know, I get kinda uncomfortable with all the negative talk about LGF. I think it kinda puts Ace in a spot.
