Franken Declared Winner, Coleman Promises To Go To Court

Not surprising, yet still depressing.

A Minnesota court ruled Monday night that Democrat Al Franken has defeated Republican Norm Coleman and should be granted the election certificate that will allow him to take his seat in the U.S. Senate.

The Coleman camp immediately vowed to appeal.

"More than 4,400 Minnesotans remain wrongly disenfranchised by this court's order," Coleman attorney Ben Ginsberg said in a statement. "By its own terms, the court has included votes it has found to be 'illegal' in the contest to remain included in the final counts from Election Day, and equal protection and due process concerns have been ignored. For these reasons, we must appeal to the Minnesota Supreme Court so that no voter is left behind."

The three-judge panel rejected Coleman's equal-protection arguments, saying that "errors or irregularities identified by contestants in the general election do not violate the mandates of equal protection."

We'll see if he goes through with the court challenge or not. At some point (fairly or not) at some point it starts to look like sour grapes to average people. Plus, it's expensive to keep these going.

Meanwhile, in upstate NY it's still basically tied in the race for the 20th CD. There are still votes left to be counted and challenges to be determined. Get ready for Minnesota on the Hudson, hopefully with a better outcome.

14 The problem, as I understand it, is that there are very strict requirements for absentee ballots in MN.  In DFL counties, they ignored the requirements as a matter of course.  In GOP counties, they did not.

So a lot of Franken-friendly votes got counted when they didn't, for example, have the signature of the witness.

Coleman wanted an all-or-nothing standard so, since the votes couldn't be uncounted, that all of the votes around the state be counted according to the loose standard.  It appears this three-judge panel disagrees.  I'm taking a stab that some court will disagree, but the Frankensteins got what they wanted -- Franken declared the "winner".

You know who this benefits?  Me, that's who.

Ding ding ding: this is invoking the federal due process grounds relied on by the plurality in Bush v. Gore in the sense of requiring a uniform statewide standard (not Scalia's statutory concurrence, which made more sense, but I digress), and by rejecting that standard the court is inviting the appeal, up to and including up to the US Supreme Court.  It ain't over.

Yep, but the ACORN-sponsored SoS in Minnesota says he "welcomes" an appeal to the SCOMN, so he must feel that the fix is in.  Unless I (I was Hugh above) have the situation wrong, it's a slam dunk in favor of Coleman.

Doesn't necessarily imply Franken will lose if they are counted, but it doesn't matter, they have to do this the right way.  Franken already got double-counted ballots as well as a few trunk-of-the-car ballots.

55 One thing that cements the notion that we really are a 50/50 nation is all the too-close-to-call congressional races. And I mean, ending in a statistical tie. Even in the bluest-of-blue states like New York and Minnesota. The rural areas, the suburbs and small towns: reliably conservative. Big cities, college towns: reliably democrat. Michael Barone, probably the sharpest sociopolitical observer out there, has called this "the great sorting-out". Or maybe we could call it "political cleansing" rather than "ethnic cleansing". People are voluntarily separating themselves by ideology.

I don't think any of this happened deliberately. It's simply an outgrowth of the human tendency to group with others of like mind. But even this conservative/liberal split might be too facile. The right has the country-club types, the "centrists" who would be Democrats in any other age, the paleocons, the religious, the survivalists, and the libertarians who tend to disagree with everyone (including each other). The left has the eco-nuts, the peaceniks, organized labor, statists, collectivists, socialists, communists, blacks, and a grab-bag of single-issue interests: gays, PETA, what have you.

It bothers me because the old American model of the "melting pot" seems to be completely broken (and maybe it was never true to begin with). It's all interest-groups and minority agendas now. (And I mean "minority" in the narrow political sense, not in the ethnic sense.) E Pluribus Unum has never rung so hollow as it does now.

A house divided against itself cannot stand. So said Abraham Lincoln, and he led us into the bloodiest war in our history to keep the Union whole. But we, fractious rebellious children that we are, have gone astray yet again.

Which reflects my waning enthusiasm for the Tea Party Protests on Wednesday.  Instead of it being a relatively spontaneous, spirited event designed to needle the Pres(id)ent and his minions, now we're being warned off that the MSM cameras are going to be there to capture anything not politically correct; ACORNitators will be there to incite tempers and possibly violence; John Liebowitz will no doubt play up the whole event as an assemblage of the slack-jawed and misinformed; and oh yeah, most of it's scheduled for the middle of the day, when we're all working.

A few years ago one of the big political arguments was whether the government should be able to restrict the amount of money individuals could spend to make their political opinions heard.

The left largely won the argument - and then turned around and abused the system they created to fund their causes and candidates.

Now we see they've gone a step further. Apparently, not only is spending unlimited amounts of money for political speech ok - but spending unlimited amounts of money to buy state politicians so that they can hand your federal politicians elections is ok also.

66 Coleman lost this election the second he decided just to let everything work itself out and maintain a civil composure while ballots were appearing out of car trunks and being counted.  When he finally decided to raise a stink about it, it stopped, but most of the damage was already done.

He should have cried holy hell from the beginning.

You do not get anywhere by using the Marquess of Queensberry rules in playing politics when the other side won't follow these rules.

The other side is not going to follow these rules until the press calls them on it.

The press won't call them on it.

Hence, you won't get anywhere.

At best you'll be seen as a gracious loser, but, more likely, just a loser.

The other side sees you as their enemy, no matter how much you wish to ingratiate yourself with them and gain their approval.  You will not get anywhere until you recognize that.

You don't. Our own Civil War was a fabulously nasty and fraught squabble. Bleeding Kansas, the bloody militia raids in Missouri and Tennessee, the regulators and bandits running around southern Illinois and Kentucky -- it was very nasty. There was a lot more to that war than just the blue and grey armies, folks. A lot more. And even after the South was defeated, there was nearly eighty years of hard feelings, anger, and emotional distance: from Reconstruction through the end of the Civil Rights era, the South never really bonded to the North.

I don't know what shape a political separation would take, to be honest. I'd like to think it would happen slowly, over the course of decades, but doing things slowly and quietly is not our way.

I don't know - Franken was a wrestler and still seems to have takedown skills. I'll give Webb the edge in punches, but if the fight goes to the ground (and they almost always do) I'd bet on Franken. Of course Webb (or an aide) is far more likely to be packing heat so Franken may get the decision posthumously.
