Why? They aren't wild eyed jihadis who are beheading the crews, they just want money. These pirates are thugs but like many thugs they are businessmen. As far as I know they haven't hurt, let alone killed, any of the captured crew. Yeah, a few weeks or in some cases months sitting around isn't any fun but these merchantmen didn't sign up to get into gun battles over containers full of TVs, stuffed animals and car parts.

Would you be willing to get into a firefight (that you are untrained for) to save your bosses property (that's insured) from someone who you are almost positive isn't going to hurt you?  I know they are well paid, but I don't think they are paid enough for that.

International Law, I believe.  I was never much concerned with this because I was teaching future naval officers, some of whom were going MSC, so I pretty much just dealt with the difference between combatant and non-combatant.

Maybe one of the on-site lawyers with some admiralty background can explain to us why the notion of having an arms locker on a merchantman is verboten.

I don't know what the deal is, with this being a Danish-flag ship, but not too long ago the U.S.-citizen crews of U.S.-flag ships were armed and were trained. They had rifles and handguns and were required to re-qualify regularly. Maybe the rules are different if it's a Danish-flag ship.

Unfortunately, that same ship has to come in to port.  Lots of different ports, with different laws.  So unless you have a mechanism to provided for the removal of mercs or guns prior to leaving international waters (not practical), or a widely accepted means of impounding the weapons aboard the ship when in port it is not going to happen.

The ship was a U.S. Flag vessel.  Under American law, any U.S. flagged merchant vessel must have an all American crew.  Because these ships are expensive to operate, they typically transport cargo between U.S. ports.  The Jones act  prohibits foreign flag vessel from carrying cargo from one U.S. port to another. Don't know why a U.S. flag vessel was operating in these waters.  Perhaps an invitation to piracy that can then be met with a violent response from the U.S. Navy?

99 Since Maersk does not call at Mogadishu (very few lines do) the Kenyan aid would have been unloaded in Mombasa and trucked from there north to Somalia and west to Uganda.  It would have been food aid from Europe probably, transshipped in Djibouti and going to Mombasa.  Given the fact that the vessel first stopped in Djibouti, the pirates would have known its approximate schedule.  Container ships going from Europe to South Africa via Suez like to swing out wide in to the mid-Indian Ocean to avoid the pirates, though in the case of a short hop like this it is probably unlikely.
