All Charges Dropped Against Ted Stevens, Criminal Contempt Proceedings Opened Against Prosecutors

Wow.

U.S. District Judge Emmet Sullivan said the misconduct was the most serious he has ever seen in nearly 25 years on the bench. He appointed attorney Henry Schulke (Shul-KEE) as special prosecutor to investigate the Justice Department team for possible criminal contempt charges.

Sullivan made the unusual move Tuesday shortly before dismissing corruption charges against Stevens. Stevens was convicted in October of seven counts of lying about gifts he received from wealthy friends.

"In nearly 25 years on the bench, I've never seen anything approaching the mishandling and misconduct that I've seen in this case," U.S. District Judge Emmet Sullivan said in the opening moments of a hearing.

Sullivan read a stinging summary of the many times the government withheld evidence or mishandled witnesses in the case.

While I'm not sure if this is the right way to go about this, Andy McCarthy argued over the weekend it wasn't, but if these charges are borne out someone or some group needs to pay. Not only did they deprive Steven's of his rights but they mostly likely materially effected the Senate election in Alaska.

BTW- for the idiotic lefties of the world who complained that the Bush DoJ was hopelessly politicized, you would do well to note that Bush and Stevens are Republicans. More importantly, the charges were leveled against career prosecutors.

3 In my utopian dream world, the ranking minority committee chairmen would get to appoint one or more senior officials in each Agency.  That would go a long way towards reducing the appearance of politicization at the executive level of these agencies.

If you want to de-politicize the agencies you need to move them out of DC.

As an Alaskan that has been watching this very closely since the beginning I honestly believe that those prosecutors cost Stevens his senate seat. There's no way in hell Mark Begich would have beaten him without this investigation and trial hanging around Ted's neck.

I am glad to see that they are opening charges against the prosecutors. It’s about time that someone had to pay for these fiascos.

 

That being said, if the newspaper write-ups are true (maybe a stretch), Stevens is getting off on a technicality. I would like to know the truth. Is he guilty of accepting what is tantamount to bribes? How many other Senators have done the same thing and not been prosecuted because they are Democraps?

 

And no, there will not be a “special election, in AK. That would only occur if Stevens had been a Democrap and a Republican had won the election.

Oh, and career prosecutors (Brenda Morris) who got their JD from Howard U and are currently teaching at Georgetown U can be safely assumed to have an ideological perspective that meshes with railroading a Republican officeholder.

Morris was involved in a botched prosecution of an Alan Brown.

Careful, there are lots of Sullivans in this case.

22 mccarthy's article seemed to ignore that these lawyers have ethical obligations that might be within the power of a judge to examine.  prosecutors often ignore their obligations and the bar associations are often quite happy to oblige them.  leaving it up to Justice is a prescription for doing nothing.

Seems there are two possibilities;

One is that these prosecution clowns are always this bad.
The other is they aren't always this bad but tried to screw Stevens.

So. Any evidence they're always this bad?

If not, why would they choose Stevens to let out their inner Nifong?  Coincidence?

Stevens tried to hurry the trial.  That must have meant he and his high-priced lawyers were confident he'd be acquitted and it would be over before the election. It would be better to be acquitted before the election than afterwards.

 That meant they knew they had the goods.  It apparently didn't occur to them that the prosecution would screw the pooch.  "You fucked up. You trusted us."

So if they knew they had the goods, to the extent that they'd risk a trial before the election, they probably did. It took an criminal act to overcome the evidence in Stevens' favor.  Which, further, means that the prosecution also knew he had the goods and shouldn't be either convicted or prosecuted. But they had a duty to prosecute.  Said who?

It’s just shots of family hugs and questions about “the system.”

34 I was a federal prosecutor for ten years.  Career prosecutors at DOJ are mostly leftists.  Career prosecutors in the Civil Rights Division are far-left, with a generous sprinkling of diversity hires, and they are and always have been blatantly, ruthlessly partisan.  The left's long march through the institutions did not overlook the DOJ.  There is not a doubt in my mind that this whole thing was undertaken from the beginning to get rid of a Republican senator.  Is Stevens crooked?  Probably.  But that's a description that fits a lot of politicians -- Reid and Feinstein come to mind -- and they've been left severely alone.

I cast one of my absentee votes for Stevens in the face of a fair amount of contempt from many on the right.  I didn't vote out of any great love for Uncle Ted, but out of the very simple expectation that Begich would vote for the Obaaama agenda.  He has, even as the majority of his constituents do not support it. 

Six years of Begich.  Think very hard about who you vote for in the Senate.

43 Special election won't happen. What's done is done. I've no doubt that Stevens is guilty of some level of corruption like every other senator out there. He was just targeted because of his rank and affilitations. I think a lot of Alaskans feel that his retirement is long overdue and this just hastened it. I didn't vote for him or Murkowski/Young....Alaskans need a new breed of representatives that believe in something other than the allmighty porkdollar.

51 I think McCarthy is mistaken - it is well settled common law that the Court has the inherent power to discipline the conduct of lawyers who appear before it.  What the Judge has indicated is that there is evidence of lawyer misconduct in a case before his Court, a matter well within his authority.
