Kundra Takes Leave of Absence

Hmmm...


Until his appointment by President Barack Obama as CIO less than two weeks ago, Kundra was chief technology officer for the District of Columbia. But yesterday, Kundra's former ninth-floor office in a downtown government building was a crime scene. A police officer was stationed in the office lobby while investigators searched through records.

A White House official confirmed today that Kundra took a leave of absence from his new CIO job shortly after federal investigators arrested two men in the D.C. government office on bribery charges. The official would not elaborate on the reasons for the leave; there were no indications yesterday that Kundra was involved in any wrongdoing.

Not a lot can be read into the leave of absence. A guilty man might not take one; an innocent man might take one, to let things get sorted out so he can return without suspicion.

For how long did Acar work under Kundra? Did they have a past history? Did Kundra recommend or hire Acar?

That seems pretty relevant. But I haven't seen the answer yet.

Some Background: Seems like Kundra was doing business with AITC for a long time.

The business had a preference in being hired due to being a "small, local disadvantaged" company. Yay for government discrimination in choosing small, local, disadvantaged and worthy companies with which to do business.

Let's begin with the contractor, Advanced Integrated Technologies Corp. (AITC). Its CEO, Sushil Bansal, was arrested in connection with the case.

AITC received a lot of work from the District of Columbia. The only "case studies" and press releases on the company's Web site concern IT projects for the District. Court documents show that since 2004, the company has done more than $13 million in business with the District. One contract, which began in July 2008 and is listed on the D.C. government Web site, was for "services" that are "not to exceed $10,000,000." Kundra was appointed in 2007.

AITC is listed by the District as being "small, local disadvantaged" on the contract, which means it's qualified to receive preferred procurement and contracting opportunities. But while AITC may be based in D.C., the company touts its offshore operations in India. Does that still count as local? What made AITC's capabilities stand out in this competitive market?

Did AITC send District IT work offshore? If that's the case, will Kundra, as federal CIO, encourage U.S. agencies -- and by extension, commercial businesses -- to send IT work offshore?

The management abilities of Yusuf Acar, the acting chief IT security officer who was arrested, are open to question, too. Was something missed in the background checks? Hello, auditors?

Kundra wants to move IT in new directions and onto new platforms, and he's established himself as a visionary. But this bribery case will bring to the forefront questions about his capabilities as a manager.

13 There are at least 2-3 other employees referred to in the FBI Affidavit by their initials that were actively involved in this corruption, in addition to an informant who was working with the FBI. I can only imagine that the others have not been named/charged yet because they are still investigating. The Affidavit makes pretty clear that they moved on Acar now because he was monitoring email traffic with investigators (pg 29-30) and was deemed a flight risk.

So there is more to come on this I'm sure...

Almost every govt project (and some large corporate projects as well) that is contracted out to their fav consultatnts, results in kickbacks to the sponsors.  The consultants bill the govt for a lot more money than what they should, and split it with the sponsor (or patron!).  Win-win for both!  Of course the tax payers (govt) loses, but who cares.

20 Another interesting tidbit  - even though he qualified as a disadvantaged, local minority business to get preferential treatment in DC, the arrested businessman CEO was an h1b visa holder.  Surely committing felony bribery should be a reason to question one's immigration status? Of course the DC court released him on his own recognizance

Acar, a native of Turkey,who earned $127,000 a year, and Bansal, who is not a US citizen but a H-1B visa holder, were arraigned in DC Federal Court on March 12 afternoon, and Acar was held in jail without bail as he was a flight risk--since he had been heard on the wiretaps saying that he intended to flee to his homeland since he felt the conspiracy would be uncovered.

Bansal was released on his own recognizance. Both were asked to surrender their passports, and Acar had a preliminary hearing on March 17 and Bansal ordered to appear in court on April 21. He was also ordered not to engage in any overseas financial transactions.

However, accountability and transparency was a major focus for him at the DC OCTO...and undoubtably he touted his accomplishments in this area to get the White House gig. Meanwhile a key direct report and others in his group were brazenly committing fraud...right under his nose...and in spite of the controls he instituted. Sources, continued to maintain that there was no indication as of now that Kundra was involved in any way in the alleged conspiracy or was aware of it, but other sources said that FBI agents had visited his DC condo building to speak to him, but had gone away after being told Kundra was not in.

39 This is about the most common scam there is in government.  For the last twenty years D.C. has been having these arise all over the city.  In fact the D.C. council changed the rules on the size of contract they must approved to like 100K from 1 million as all the department heads under the last few mayors were giving their friends 999K worth of contracts.  You are also right that the desire to use D.C. and minority owned businesses has helped this problem as there are only so many qualified to do the job.  There is just too much temptation in the budget.
