Vicki Iseman Settles with the N.Y. Times ... for an Op-ed? BUMPED
Also, N.Y. Times Suspends Dividends

Huh. Just huh.

Editor and Publisher says that Vicki Iseman, who was defamed by the N.Y. Times at the height of the presidential campaign has settled. Iseman sued the newspaper for $27 million dollars after it claimed that she had an "improper relationship" with John McCain.

What'd she settle for?

The settlement, which does not include any payment, retraction or apology from the Gray Lady, includes an agreement for the Times to post an online Op-Ed from Iseman's attorneys. Executive Editor Bill Keller will counter with his own Web essay.

Washington Bureau Chief Dean Baquet told staffers in a memo Thursday that the settlement essentially vindicates the Times' reporting, noting to them that "We paid no money. We did not apologize. We did not retract one word of the story, which was a compelling chapter in the tale of Senator John McCain and his political rise."

Talk about a fizzle. Click over to read Baquet's crowing letter to staffers about the "deep reporting, dozens of interviews and an abundance of caution" that led to the original article on Iseman's romantic connection to McCain.

It seems the center of their dispute and the reason they settled is because of the good old N.Y. Times v. Sullivan defamation standard.

Related: Okay, not really related to Iseman, but still connected. The N.Y. Times has suspended dividends on its securities. Arthur Sulzberger, Jr. cites the need for "financial flexibility" and an "uncertain business outlook."

I mean I know the Times is (demonstrably) not worth the paper it's printed on, but she could have at least gotten a pile of that rich Mexican dude's money.

Call me a cynic but I doubt if the entire story will ever be known.

The tone of the memo from the DC Bureau Chief leads me to believe that the Times had something but couldn't come up with proof, so they went with what they had at the time.

Senator McCain will be campaigning around these parts pretty soon, but I doubt if this issue will come up. So far, there is no talk of any primary opposition, and no firm Democrat opponent, though there are plenty of well known pols on both sides.

Bullshit. They picked out one of McAmnesty's female advisors, knowingly spun a tale about her and humped it into submission.

But I'm betting that they found out something embarrassing or sordid about her after the lawsuit and used it to squash the lawsuit. If so, I wouldn't count on the NYT to keep it secret for long. No more than 2 months is my guess.

16 My guess at the time was that McCain was tinglyfor her, and she, sensing this, strung the coot along just enough to get some advantage around the office. His not so favored staffers whined about it, vaguely, to reporters who were left to 2+2 it themselves. Being reporters, they half-assed that and got sued.

My guess now is that since then, someone ratted her out less vaguely. End of suit.

And I'd bet the NYT would bombshell it in their response if her lawyer took the wrong tone, so he's gonna wuss it.

18 She had to take the settlement.  The NYT never actually said they were having an affair, only quoted unnamed staffers as fearing it.  Her legal standing as a prominent DC lobbyist may have also placed her in the category of "public person," raising the bar for defamation considerably.

They admitted they had nothing, despite the elaborate obfuscation of their "statement."  They hid behind the technicality that they had not overtly claimed an affair had existed at any time.

For the Times, the mild statement is cheap at the price.  It saves them massive legal bills and the chance - however remote - of losing a huge judgment.  Perhaps most of all, it spares an extensive discovery into their reporting and editing on this story, which could generate far worse publicity for the paper than printing that vanilla disclaimer.

Incidentally, you can now own a share of stock in the NYT for less than the newsstand price of the Sunday edition.  The really bad news for Pinch - the little weasel has survived a drastic downhill ride already - is that they are now suspending dividends out of financial necessity (no profits to distribute).  The company is controlled by the voting stock of the Sulzberger and Ochs families, and dozens of those clansmen depend solely upon NYT dividend checks to pay for their extravagant lifestyles.  They've given Pinch the benefit of every doubt as long as he kept the checks coming.  How long they will stand idly by without the cash to pay their personal trainers is anyone's guess.

Another idea, buy the stock and demand the certificate.  That's got to cost The Times some money, just to produce a certificate. Then give a certificate out as a tip at the next liberal hippie restaurant you visit in NYC.

36 In fairness, after opening down a nickel, NYT has risen about 0.25, which effectively takes them back to price levels before the announcement of no dividends. Certainly, people are buying in at the new-sub-$4.00 price ($3.44 might be the modern day low). But obviously they're buying because they think the price will increase. Why?

Yes, thanks to that BS ruling from the liberals it is practically impossible to sue a fucking news organization for slander anymore. It was already difficult but that made it impossible. Even before Sullivan newspapers took exceptional pains to be Unfair and Imbalanced in reportage and often it resulted in THIS KIND OF ACTION.

 

What needs to happen is to bring back the Code Duello. When some scuzbag reporter prints lies and innuendo (which is all the NYT prints) then the aggrieved party challenges the reporter and editor to a duel. Soon the NYT would be out of reporters, or at least it would have honest reporters.

 

The really sad thing about Sullivan is that it was supposed to protect the “free press”. What fucking good is a “free press” when it is nothing more than a propaganda arm for the Communist Party.
