Bobby Rush: How About we License the Bitter Clingers?

The debate over the 'stimulus' bill is sucking up most of the oxygen in the blogosphere, but there are other bills worth keeping an eye on. HR 45 is one such bill. What would it do?

U.S. Representative Bobby Rush (D-Ill.) recently sponsored H.R. 45, also known as "Blair Holt's Firearm Licensing and Record of Sale Act." The bill is, at its core and as its name implies, a licensing and registration scheme.

The measure calls for all handgun owners to submit to the federal government an application that shall include, among many other things: a photo; an address; a thumbprint; a completed, written firearm safety test; private mental health records; and a fee. And those are only some of the requirements to be licensed!

The bill would further require the attorney general to establish a database of every handgun sale, transfer, and owner's address in America. Moreover, the bill would make it illegal to own or possess a "qualifying firearm" -- defined as "any handgun; or any semiautomatic firearm that can accept any detachable ammunition feeding device…" [emphasis added] without one of the proposed licenses.

Here's the text of the legislation. Rep. Rush has been unsuccessful with this bill before, but now he's got a liberal president, a huge Democratic majority and an anti-gun attorney general to help him out.

Just something to keep in mind, and a reminder that we have a lot of battles ahead.

This law has very little chance of passage, but here's an interesting little tidbit:

H.R. 45 is essentially a reintroduction of H.R. 2666, which Rush introduced in 2007. H.R. 2666 contained much of the same language as H.R. 45, and was co-sponsored by several well-known anti-gun legislators--including Barack Obama's chief of staff, Rahm Emanuel.
So far, no co-sponsors, but Rush certainly has a...sympathetic ear in the White House.

6 EC, your right - I actually hope this passes on a party line vote. It won't stand-up in the courts, but it will ignite the base. If the stimulus was pouring gas on the base, this would be the match. Bet Rush and the Blue Dogs have to be physically seperated in caucus meetings.

10 This is going to make a lot of people felons in the eyes of the Federal Government when they refuse to submit to these outlandish requirements just to observe their Second Amendment Rights.
I can already predict that some of the more redder states are going to push back hard, claiming soverignty under the 9th and 10th Amendments of the US Constitution.

28 It actually doesn't make sense administratively. This law will turn every two-bit felon into a federal defendent in addition to the state or local offense. We would have to re-open Gitmo.
The anti-gun crowd is smarter then this; either Rush is off reservation or this bill is a Red Herring in some larger legislative initiative. E.g.: this takes the heat, is killed by Democrats so they look moderately pro-gun and something "reasonable" passes under the radar.

33 Honest question from someone who currently does not own a firearm, and thus has never had to go through whatever is currently required to do so. Reading the list of requirements in the snippet-box...isn't this basically the same stuff that we have to go through in order to get a driver's license? Granted, those are state licenses, not federal ones...but photo? Check. Address? Check. Pass a safety exam? Check. Fee? Check. All in a readily-accessible database? Check.
I'm not saying I'm for this bill. I'm only skimming the surface with what is presented here at AoS. I'm just trying to gather a little perspective.

For me, the difference is that I have a constitutionally-protected right to own a firearm. Driving a car is a privilege under the law. Owning a gun is a right, and it's not up to any government agency to 'approve' that right by necessitating a license.

There have been no cases making it to the Supremes since Heller (at least that I am aware of). As for this law being outside the bounds of “reasonable” you are right. In a true and honest reading of the second amendment there would be ZERO laws that reduced a citizen’s ability to own any weapon.

The again, in a true and honest world Bobby Rush would either be dead or in jail instead of in congress proposing unconstitutional laws.

So don’t hold your breath expecting a court to throw out this law based on “reasonableness”.

Guns are a funny thing to me. I certainly do not disagree with any mentally-sound, non-felon's right to ownership. I guess I do have a touch of liberal in me, in that I definitely agree that there is a certain segment of our population that has no business owning a gun. Unfortunately, we only seem to figure out who they are after they've used one against another individual...
I don't know. I don't see too much issue personally with a "handgun license" per owner. It should be kept innocuous and basic enough that really the only people getting filtered out are the ones who hear voices telling them to kill their boss, and felons who have previously proven themselves incapable of controlling themselves in a lawful society. Not trying to open further cans of worms, here, so please don't mince my words here too much.
Registering each individual gun is probably overboard. I understand the altruistic concept that, by registering all handguns everywhere, somehow crimes committed with a gun will somehow be easier to solve, try, and convict. But I'm far to jaded to actually believe it will make a difference. Registering each individual gun will only place undue burden on the law-abiding citizens, and do nothing to those who will go out and commit crimes anyway. Make it easy and simple for gun ownership to exist. Definitely put out some basic screens to filter out those who have already forefited their rights in this country and are deemed mentally unable to grasp the gravity of their own actions, and let Ginger buy all she wants.
Please oh please oh please do not open this up into discussions of whether or not felons should own guns, which felonies should/should not apply, or the intricacies of mental health parameters...do not take my post there. Put it down. No. It's not going there. Do, however, feel free to smack me around a little and show me how I'm wrong!

63 I just had a shooting lesson last night and the instructor brought up HR45. He seemed to think that if this becomes law, anyone with a semi-automatic would have to turn it in. He seemed to think the person who is the bigger problem (other than Bobby Rush) would be Eric Holder. He played a part in the D.C. handgun issue.

I live in Washington state, and even though it is a liberal voting state, purchasing a gun and obtaining a concealed weapons license was straightforward.

It doesn't seem possible that gun owners will put up with this nonsense. Hopefully Republicans can get their shit together before 2010 and this bill will drag on with the help of those who believe in the Second Amendment.

One of the things that needs to be understood is that registration has NOTHING to do with crime prevention or safety. Not trying to beat up on you, because I once held similar views.

Consider the background check system. On the face of it, the instant background check seems reasonable; weeding out the felons and demonstrably mentally ill. But the states and feds are supposed to purge the background check info afterwards. Many states conveniently "forgot" to do so. Delaware was recently caught stockpiling these records. In this case, a Delaware woman was denied a gun purchase because they thought she was too old. Last time I checked, the Bill of Rights applies to all Americans, regardless of age. The record-keeping thing came out as a side issue.

Our freedom and our rights are too important to be held at the whims of government bureaucrats.

Speaking in terms of political pragmatism, that bill has no chance in helll of making it out of the House. It is meant as a trial run so future gun control measures can be assessed. Teh Obamessiah is not gonna push overt gun control like the dearly departed Assault Weapons Ban, and then get thumped for it in the mid-terms. He is not THAT willing to stand on principle. (Yeah, yeah, I heard all his pretty talk on the TV before, during, and after the election. The man has the political depth of a coffee saucer. We will see this truth revealed well before Thaksgiving '09.)

Still, it's nice to know where everybody's true sympathies lie, right? Keep buying the guns ammo, people, the more you have, the less likely anybody is going to want to take them away.

PS, the idea of gun-restriction legislation coming from an ex-Black Panther is funny. Those guys hung out with all sorts of unlicensed weapons, which they used to scare off the Kluxers, and intimidate neighbors who didn't buy into their ethnic Marxist platform.

85 I've heard and read many people that are of the opinion that so called licensing doesn't have to be draconian or unfair , you know , somewhat analogous to drivers permits and what not . The problem , as I see it , would be when a new administration takes over . Their idea of what constitutes reasonable and fair could well be vastly different , and not in a good way . Imagine say a Zell Miller firearms policy versus one run by Pelosi or Kennedy . Night and Day. The most expansive interpretation of the 2nd amendment is the only way to ensure permanent firearm rights.

I had to take a written test, provide a copy of my drivers license and a utility bill, pay a fee for taking the test, pay a fee for a federal back ground check, wait 10 days, demonstrate that I could chamber and unchamber a round, prove to the state that I had a proper container for the gun (excused if gun comes with a trigger lock).
It wasmore complicated than purchasing a caror voting.

105 I recently got my concealed carry license in NC, without it,NC always made you appy for a purchase permit for every hand gun you purchased. Since you turned the permit in to the seller I though the state kept records of gun ownership, but that's not the case. Those purchase permits are "supposedly" destroyed. The only records kept are of handguns reported stolen. The state knows who applied to purchase a gun but they do not know if you did buy one or what type it was.
Now withthe concealed carry permit I can buy as many as I want for the next five years without the hassle of state paperwork and waiting periods.$75 class, $90 for the fingerprinting/background check, 4 week wait.

That’s fine for incorporation, however, Heller already ruled that rights may in fact be abridged. The ONLY good ruling in Heller was that it was an individual right and outright bans were forbidden and use for home defense was acceptable.

The text even states in there somewhere that “reasonable” restrictions such registration and limits on the number and type of firearms was permitted.

To those of you who think that registration of handguns is OK and that laws in like the one in NC requiring a CCP to buy a gun are OK should go back and read the Constitution.

Shall NOT be abridged is pretty clear. If they want these things they should be REQUIRED to amend the Constitution to get them. If we go with the way they interpret the Constitution to mean anything we could say that it permits us to round up Bobby Seal and hang him for past crimes and as long as we had 5 Nazis on the court they would agree.

The phone rings every 2 minutes and they either ignore it or pick it up and say they can't talk. They can't get enough sales people in and there's a steady stream of customers. I'm a first time buyer and they didn't have time to educate me, I'll hire a private instructor and pay him to consult with me on a purchase. The shop I went to has a picture of Obama on the wall with the caption "Salesman of the Month."

In the vast majority of cases I think people are much more likely to hope they don't have to take up arms, but the question is, at what point do you do so? For the last two years that I have been visiting conservative blogs, it seemed as though the focus was on educating about how this <turn toward socialism> could come to pass... and if enough people would just care to take off the blinders and really look at what was happening, perhaps we could avoid the need for revolution.

The states won't do it themselves because they're not going to want to pay for it. In Canada, the provinces wouldn't have anything to do with it so the Federal government had to take it over. Hasn't saved one life yet.

If handling-safety tests before gunlicensing are for public safety, then simply excerpt the relevant sections of that training and require every citizen to take it. It can't hurt anyone to know, and there's less force involved than in seizure. Anyone who argues against this premise has just shownhis hand. (Well, actually, I do have a problem with it. Like sex and poetry, I don't want it taught in public schools because they can't do it right.)

My sense is that it is a sort of recent phenomenon, and a distinct and strong one. I know you guys are kinda gun oriented, but I've been seeing a lot of this talk on all the other conservative blogs.

I have always been conservative, but I have never before been alarmed like I am now. VERY alarmed. So probably lots of others are like me and feeling the same.

Things are just so outrageous, and so many things on top of so many things, I figure it's going to come to a head at some point. Every day it's some new and unbelievable travesty.

As for guns, my guess is that the value of having guns would not be so much for fighting off the government, or for actual civil war (though keeping guns would discourage needing to fight off tyranny), but rather, to protect oneself and one's family and goods if resources get scarce, and people start trying to take things from others by force.

As for how it will all end up, I have no idea. I don't know if people will demand their freedoms and that we adhere to the constitution, or if they'd rather play American Idol. Either way, I figure there's some rocky road ahead, and that doesn't even COUNT the problems resulting from this lousy new foreign policy.

I do know for sure, though, that I won't have much money after it's all said and done! And what I have, they will want, to give to someone else. I've known that since last summer.

There's nothing that will make you snap out of your complacency quite like the threat of having your very rights trampled upon. Now, every timeI turn on the news I feel like I want to scream. We need to cut the legs out from under these bastards right where they live because once they achieve a name for themselves and start to climb the political ladder, less informed people will be casting their vote for them based strictly upon name recognition alone.
I already own a Springfield XD40 and love it, but would like to purchase a second firearm in the next couple of weeks or so. The Springfieldis a great gunbut I'm considering either a small shotgun for additional home protection or a nice, simple to use revolver. Actually, the more I think about it (and type about it) I realize that I'm likely purchase both in the not too distant future.
I'm not looking for a pea shooter so, any advice?
