MN Supreme Court Tosses One Of Coleman's Main Hopes

Consider this an update to Ace's earlier post.

The Minnesota Supreme Court has rejected a lawsuit crucial to Sen. Norm Coleman's (R) reelection fortunes, clearing a path for the state Board of Canvassers to certify Democrat Al Franken as the state's next senator.

Mirroring its reasoning in a previous decision which rejected a Coleman suit on so-called "duplicate" ballots, the court said that Coleman's bid to include an additional 650 absentee ballots in the contested Senate race was an issue best-suited for the Board of Canvassers.

The ruling disarms Coleman of one of his last major opportunities to overcome the 225-vote lead held by Franken after the inclusion of hundreds of absentee ballots disqualified for no legal reason.

So, Franken will be declared the winner today and then it will be up to Coleman to sue or not to overturn the result of the election.

Meanwhile, the Senate meets tommorow for the first time in 111th Congress. Will they seat Franken if there are challenges before a court? Chuck Shumer says yes, John Cornyn says no.

As the man said, Worst Election Ever.

1 Wow.

They don't even think they need to hide the body anymore.

2 I thought from their previous running that this was a given.  Coleman will need to actually challenge the election to bring this stuff in.

3 Before anyone even dares say it: no, we should not knuckle under and take this sitting down in some act of false-decorum and collegiality--force is the only thing these fascists comprehend and playing go along to get along is a recipe for continuing disaster.

4 It is not about election anymore; that is the point. Now it is merely a matter of one party manipulating the machinery and RINO tools looking the other way while the commie-libs do it.

5 I'll say it again:  he must have done a pretty lousy job to even let Franken get this close so he could take it from him.

Posted by: kina at January 05, 2009 01:26 PM (JpqtI)

6 5: Coleman wasn't the ideal candidate, but did you sleep through the anti-Republican election of '08? What could the guy have done in a state like MN to improve his odds? Promise free lutefisk to anyone that voted for him?

Posted by: ECM at January 05, 2009 01:35 PM (q3V+C)

7 Even though people argue that a 2-way election would have elected Franken, I'm not so sure.  In a 3-way election, the campaign focuses on the incumbent and not the asshat challenger.  Two against one.  Negative ads against the asshat don't work.

8 Minnesota gets what it deserves.  Elections have consequences dont'cha know.  You Betcha!

Posted by: JOHN ADAMS at January 05, 2009 02:47 PM (Q8yq5)

9 According to the Yahoo News story the reason the court tossed this claim is because it would best be judged by an election challenge or a lawsuit, so Coleman isn't dead yet.

"Coleman had argued the ballots were improperly rejected. In a five-page ruling, the high court said the dispute was among issues better handled in an "election contest," or lawsuit."

10 Minn elected a washed up, never was pro "wrestler" as Gov a few years ago. Is it any surprise they'd go for an unfunny, never was "comedian" who has never held any kind of public office - let alone a real JOB - in his entire useless life, as a Senator?

The state is a liberal sewer.

The problem with the entire election process now is the GOP RINO's have let them get away with this kind of shit for so long now, they have made "rules by fiat". Like their lies, "say it long enough and people will believe it's true." Cheat on elections long enough, and this is what you get. But oh - the hue and cry when they lose an election they tried to steal!!! Algore, anyone? This is just payback for these scumbags, is all.

Posted by: Bruce at January 05, 2009 02:54 PM (rdFaW)

11 One the one hand, Coleman pretty much sucked. In a sane world he'd be a nice liberal Democrat, which was all he ever wanted to be.

On the other hand, .... Al Franken? At this rate the Donks will run Bill Ayers for a Senate seat, and win. Time to hoist that black flag.

That's very true. But the irony (love that word) is that Coleman is exactly that sort of RINO. These peoples entire mission in life seems to be to enable the leftist takeover. I believe the phrase "useful idiots' applies.

13 Coleman wasn't the ideal candidate, but did you sleep through the anti-Republican election of '08?

That's one of those mobius strip problems. Did Coleman "lose" because it was a lousy Republican year, or was it a lousy Republican year because of an excess of Coleman-type figures in the party? The two are tied together.

(I use the scare quotes because we all know that technically, he did not really lose. But he failed to win enough votes to overcome the inbuilt Dem advantage.)

Posted by: flenser at January 05, 2009 04:09 PM (pcpcF)

14 The article and the AoS blog post are completely wrong.

Coleman still has a new, different lawsuit he can file challenging the election. If Coleman decides not to file it, the only explanation is either he is too chicken or he would lose anyway.

If Coleman doesn't file suit after all this, and he or his supporters still whine, that is the stuff of crybabies.

Posted by: Indythinker at January 05, 2009 04:12 PM (WiIQi)

15 Should have just held a new election.  The recount was a joke, and they almost always are.  Smalley would have lost handily without Obama's coattails a anyway.

Posted by: brak at January 05, 2009 04:41 PM (sdYWb)

16 Once it went from a 700+ vote margin to a 200+ margin, it was over for Coleman.  The dems can find 400 votes in their sleep.  There was never any doubt that Franken would be a senator.

Newsmax has a nice recap of what has happened. I know Newsmax is a Dick Morris thing, but when you read the recap it makes you mad all over again about how this came to happen and seems totally egregious.

The whole thing is so frustrating, I've kind of compartmentalized it to aviod getting angry over and over again about it. And the MSM is as silent as a tomb.

So, here we are, about to get shafted and I get the feel many of us are almost resigned to it at this point. Which is what the leftist "winter soldiers" count on. They are relentless, and most of us who have other lives get sick of the whole thing. Ugh.

19 I get the feel many of us are almost resigned to it at this point.

It's not like we've never seen this happen before.

The GOP had the chance, during their time in power, to do something about the joke which are our elections. Just one more thing they dropped the ball on.

Eh?    Jesse Ventura was also a US Navy Seal.   And he played a "God-damned sexual Tyrannosaurus Rex" in Predator.

23 No, you idiot: he played a real seal - you know, balancing a ball on his nose and slapping his flippers together for raw fish. The local aquarium's real seal died and they needed a quick substitute.
