Good God: Blago's Bud Burriss Sought Death Penalty for Obviously Innocent Man

It's hard to explain how egregious this is without the details -- someone sent me the headline hours ago and I took no interest.

Not a big deal, I thought, if Burris wrongly sought the death penalty for an innocent man. Mistakes do happen.

But that's not really what happened here. His own prosecutors kept telling him the man he wanted the death penalty for was innocent, and even resigned in protest.

Burris didn't care.

While state attorney general in 1992, Burris aggressively sought the death penalty for Rolando Cruz, who twice was convicted of raping and murdering a 10-year-old girl in the Chicago suburb of Naperville. The crime took place in 1983.

But by 1992, another man had confessed to the crime, and Burris' own deputy attorney general was pleading with Burris to drop the case, then on appeal before the Illinois Supreme Court.

Burris refused. He was running for governor.

Burris' role in the Cruz case was "indefensible and in defiance of common sense and common decency," Warden said. "There was obvious evidence that [Cruz] was innocent."

Deputy attorney general Mary Brigid Kenney agreed and eventually resigned rather than continue to prosecute Cruz.

Once Burris assigned Kenney to the case in 1991, she became convinced that Cruz was innocent, a victim of what she believed was prosecutorial misconduct. She sent Burris a memo reporting that the jury convicted Cruz without knowing that Brian Dugan, a repeat sex offender and murderer, had confessed to the crime. Burris never met with Kenney to discuss a new trial for Cruz, Kenney told ProPublica.

"This is something the attorney general should have been concerned about," Kenney, now an assistant public guardian in Cook County, said in an interview. "I knew the prosecutor's job was not merely to secure conviction but to ensure justice was done."

Kenney was not alone in her beliefs. Prior to Cruz's 1985 trial, the lead detective in the case resigned in protest over prosecutors' handling of the case, according to news reports at the time.

And rather than argue Burris' case before the state supreme court, Kenney also stepped down.

"What I took away was that [Burris] wasn't going to do anything to seem soft on crime," Kenney said. "He didn't have the guts."

In her resignation letter, Kenney claimed Burris had "seen fit to ignore the evidence in this case."

"I cannot sit idly by as this office continues to pursue the unjust prosecution of Rolando Cruz," she wrote. "I realized that I was being asked to help execute an innocent man."

Burris' response at the time: "It is not for me to place my judgment over a jury, regardless of what I think." (We have also left a message for Burris at his office and will post an update if we hear back.)

State prosecutors carried on with the prosecution, even after DNA evidence in 1995 excluded Cruz as the victim's rapist and linked somebody else, sex offender Brian Dugan, to the crime.

DNA exoneration, and implication of another man. That other man confessing. A lead detective and top prosecutor resigning in protest.

I believe they call these "red flags" in the legal business.

9 I'm not sure of the legal rules for this, but Rolando Cruz was somebody who arguably "deserved" the death penalty, even if he didn't actually kill anybody.  He wasn't an innocent victim picked out by prosecutors.  Instead, they had a reward for information about the murder.  Rolando Cruz wanted money really bad, and so knowingly made up false information in order to get the reward.  However, he accidentally made up some information close to the actual facts, and so the detectives involved decided he was the murderer, and then framed him.
Legally, all he did was provide a false statement to the police, and didn't deserve much punishment.  Morally, I couldn't care less about executing somebody who interferred with a murder investigation and tortured the family just for money.

No, the county of Du Page carried on with the prosecution. The AG only represents the state on appeal. The county DAs filed and tried the case. They are two separate offices - one county and one state. Also, it was alleged that multiple defendants were involved, so how does the fact that Cruz was excluded prove innocence? Additionally, I believe Burris was out of office in January 1995.

I can see why people don't care for this guy or Blago, but I find the attacks on Burris for the Cruz case ridiculous and the attacks on Blago's sanity, creepy scary--a tactic used by the commies.

If he believes his own appeal would work an injustice, absolutely: he should voluntarily dismiss the State's own appeal.

Plover, your arguments are semantic hairsplitting bullshit, and as a prosecutor myself I find them beneath contempt.  A prosecutor's duty is to seek justice, period.  If that means voluntarily dismissing an arguably non-frivolous appeal, so be it.  If multiple prosecutors resigned in protest rather than be a party to something like this, something BAD was going on.

That's a cop-out if I've ever heard one.  Forget about the Senate: my initial reaction is that Burris should've been disbarred for this.

24 I was living in Chicago at the time and remember that this was a really big deal.  The thing is, you expect judges and AGs and anyone else in a position to put people to death to use their heads and common sense, so that, even though there remain procedures to be followed, you don't push for people to be put to death when reliable evidence suggests their innocence.

So, whilst I understand those who would say "he couldn't just drop it," to some extent, there remains the fact that morally he had to drop it, and without that moral sense he shouldn't have been Attorney General.

25 Burris is not a strong public servant but the Cruz case is more complicated than the media accounts. All the supervisors above that assistant disagreed with her. The other guy confessed "theoretically" and Cruz had essentially implicated himself and his buddy. The Chicago media turned case into a jihad against Republican prosecutors and forced a political prosecution of some of the early prosecutors and cops. All were summarily acquitted and Cruz never got much in a civil case because he had so much culpability in his own predicament.

One, obviously he didn’t believe it. Two, Cruz was the one appealing, not the AG. Three, appeals are limited to the record. The AG can not argue on appeal evidence that is outside the record. You claim to be a prosecutor, but you are woefully ignorant of the basic rules of appellate law and the rules of professional responsibility and ethics associated with appellate law. Call me unimpressed. I don't see how you can call the appeal frivolous when the court ruled 4 to 3 to affirm the conviction. I know of only one prosecutor criticizing the case in her resignation letter. However, that is not evidence.

This is prosecutorial misconduct of the first water.   It's not just an abuse of the discretion prosecutors have to bring charges, but abuse abridging the fundamental rights that any defendant in any court has and may bring in his defense.  The laws are being laid down all around us.

Hard to imagine, I know, but the system pretended it was honest and Burris was just going with the flow. Cruz had been convicted, appeals ran out, etc, not much else for Burris to do at the time. DNA evidence, not technologically available previously, saved Cruz.

Besides, if Cruz didn't do that, he probably did something, was the thinking. Not much efficiency in Illinois, except the conveyor belt on death row.

When the facts are clear we can argue Burris' actions and condemn him if necessary.

Some denigrate military courts . Not me. I'd rather have my case before a panel of judges that have almost no legal training. My old man , like most officers, had to serve on court martials occasionally . He had one book . I believe it was called manual for courts martial , or something along those lines . Morons can correct me with the proper title.  It probably contained more than enough information to judge someones guilt or innocence. Military courts are not perfect , Breaker Morant being a good example . But still.

Give me a panel of army officers , any day. Fuck lawyer politicians!

A grand jury later indicted four sheriff's deputies and three former county prosecutors for their roles in the Cruz case. They were eventually acquitted. Burris was never accused of any wrongdoing or misconduct.

 

A terrible miscarriage of justice.  All seven of those fuckers and Burriss were guilty as hell of trying to railroad an innocent man.  I remember the court cases and all the damning evidence against the government in that case, the jury must have been retarded.  It really frightens me that those bastards could get away with what they did just because they were law enforcement.  If they know juries won't hold them accountable when they cross the line what reason do they have to restrain themselves?

A savvy politician would have sidetracked the proceedings into a special review process until after the election, sounds like he just tried to sweep it under the rug.

As far as the Cruz case is concerned, it was my understanding that Cruz knew non-public information about the Jeanine Nicarico case and was immediately suspect. 

There were three individuals who were suspects in the case:  Cruz, Hernandez and Dugan.  Cruz and Hernandez were suspects because they knew details that were only known to the police.  Dugan confessed two years after the murder but there were concerns he was making it up to get media attention because some of what he confessed didn't match up with the evidence.  Dugan was already in jail for murder when he confessed.  The case was very muddied and a numbskull like Burris wasn't going to figure it out.  Hence his choice not to rock the boat.

Prosecutor and judge, experts as applicable (Expert supressed / glossed over exonerating evidence).

They are given power of life or death, and this the price they pay for: Unless they are really sure - bet their own life sure - that the defendant is guilty* they should not put him/her to death. Because even this was their very first case and now they 120 and decrepit in a retirement home they will still join an innocent man in death.

*An exonerating circumstance might be that while did not do all or only some of the deeds he was accused of in the trial that latter investigation showed that he was actually guilty of something death penalty worthy. But wasn't prosecuted because a) already death or b) gonna be dead soon, why bother ?. They still would lose govement employment and/or benefits/awards they have accumulated since then.
