Chutzpah, defiance and the hair...that's the Blago we've come to know and loathe.

Gov. Blagojevich today is expected to name former state Comptroller and Attorney General Roland Burris to Illinois' vacant U.S. Senate seat, a knowledgeable source said this morning.

A news conference is scheduled for 2 p.m.

Former Illinois Attorney General Roland Burris, 71, had lobbied the governor for the position in recent weeks.

Here's Burris' law firm bio. He's obviously a party guy and my guess is everyone will say nice things about him, his unquestionable personal integrity and how he represents a choice everyone can agree on so no taint here, move along and we'll fight it out in two years. Cause that boys and girls is the Chicago way.

Below the fold is a letter Harry Reid and all the Democrats in the Senate sent few weeks back to Blago saying don't make an appointment.

We write to insist that you step down as Governor of Illinois and under no circumstance make an appointment to fill the vacant Illinois Senate seat. In light of your arrest yesterday on alleged federal corruption charges related to that Senate seat, any appointment by you would raise serious questions.

It is within the authority of the Illinois legislature to remove your power to make this appointment by providing for a special election. But a decision by you to resign or to step aside under Article V of the Illinois Constitution would be the most expeditious way for a new Senator to be chosen and seated in a manner that would earn the confidence of the people of Illinois and all Americans. We consider it imperative that a new senator be seated as soon as possible so that Illinois is fully represented in the Senate as the important work of the 111th Congress moves forward.

Please understand that should you decide to ignore the request of the Senate Democratic Caucus and make an appointment we would be forced to exercise our Constitutional authority under Article I, Section 5, to determine whether such a person should be seated.

We do not prejudge the outcome of the criminal charges against you or question your constitutional right to contest those charges. But for the good of the Senate and our nation, we implore you refrain from making an appointment to the Senate.

I don't know Illinois politics... thank goodness. But how sympathetic is this Burriss guy, anyway? He's old, he's black, I assume he's been a party stalwart for years.

Is it going to be where Senate Dems will be faced with a type of situation where people say "C'mon, let the old guy be senator. Don't be a meanie. Don't take it away from him. He's been a team player for his whole life and this will fulfill a dream, etc., etc."

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

There are several cases where on house or the other has refused to seat the declared winner of an election, even going so far once as to compel a new election once (NH in the '70s I think).

No court will hear a challenge to whatever decision the Senate makes.

But weren't those contested or very close elections?  There is no election irregularity here.  While there is a lot of hand wringing about Blagojevich, he still has legal standing as the governor of Illinois who is empowered to appoint a replacement Senator.  And there's no taint on Burris, an upstanding black Democrat who is clearly qualified to be a U.S. Senator.

If the Illinois legislature is so hell bent on blocking Blagojevich, they should impeach and convict him and remove him from office. 

But that would mean talking about things that they don't really want to talk about.

It's all very amusing, really.

87 First, the idea in Adam Clayton Powell's case was that after he had been expelled from the House, with full knowledge of why he was expelled, his constituents re-elected him.  Fundamentally, SCOTUS was saying, sure, you can expel him once for a reason, but the voters get the final choice.

As for Roland Burris, as a long-time resident of Illinois, I remember him all.  He grew up in segregated (he wasn't allowed to swim in the city pool) Centralia, IL, a coal-mining community.  He worked his way up the Illinois political ladder by being not the 'Magic Negro' but by being an early version of Steve Urkel without the annoying whining voice.  That is, he was bright, non-threatening, eager, smiling, and so on.  He ran well until he ran for governor in the Democratic primary in 1994.  He went up against Richard ('Dick") Phelan and Dawn Clark Netsch.

Phelan ran as the lawyer who brought down Speaker of the House Jim Wright (I think).  Netsch ran as the 'outsider' (she had been a member of a group of dissident Dems in the IL legislature called 'The Crazy Eight.')

Oddly enough, the election apparently turned on campaign commercials.  I still have tapes of them, since I was a member of a group doing research on tv coverage of the election.  Burris played a commercial that showed him striding down a set of steps towards a big, black limo trailed by two beefy white guys in overcoats who looked like members of the mob.

Phelan used a commercial that showed him firing an M-16 (I think -- full auto something anyway) at a range.  He looked like he was picking a very angry rattlesnake.

Netsch had a commercial that showed her (she was about 70 and looked it) shooting pool in a local family tavern in Chicago somewhere.  She lined up a tricky shot and made it.  Camera caught it all.  Then the camers panned up to her and caught her in one of the most genuine laugh and smiles I've ever seen on a politician.  Wrapped up the election right there.   The polls showed it almost immediately.

Anyhow, Burris had the luke-warm backing of the Machine, but whoever won would have been beaten by the sitting governor, Jim Edgar.

So, long story short, Burris is not terrible.  He's not great, either.  He never really won any state-wide race that wasn't pushed really hard by the Machine.  He was chosen generally as an adequate black candidate who would prop up the rest of the ticket among black voters in Chicago.  Like all politicians, he has both a big ego and an unwarranted belief in his own abilities.

Does the Qualifications Clause empower the Senate to deny seating Burris?

As the Powell case demonstrates, the Senate's power of being the judge of qualifications is not wholly unreviewable or absolute.  If the Senate had absolute authority in this way, then whoever was in the majority could simply arbitrarily refuse to recognize the qualifications of people in the minority elected or appointed. 

In other words, if they could reject Burris simply because appointed by Blago, who undeniably has the legal authority to make the appointment, and because Blago is under investigation, then what would stop the Dem majority from refusing to seat a person merely because they were appointed by a Republican governor who was not under any cloud of suspicion?

The Qualifications Clause is not a tool of tyranny and despotism.  As usual, Harry Reid is talking out of his ass, and what he is saying is the usual stuff that comes out of an ass.

I didn't see the press conference, but Bobby Rush is recovering from a very serious bout with a rare form of cancer, and just returned to work in late August, so he may still not be 100%.

Some of you may recall that Rush thrashed Obama soundly in their 2000 primary race for Congress. He more or less openly campaigned against Obama as not being black enough, casting him as the favored candidate of white liberal Hyde Parkers (sorry, no links, working from memory since Rush is my Congressmen and I do vaguely recall the 2000 contest), so basically this is all pretty interesting.
