Source: TARP Bailout Not a Done Deal; May Even Include the Concessions Corker Demanded for the Senate Bailout

Here's hoping Larry Kudlow's source is right:

But my sources tell me that the TARP deal is not done — not by a long shot.

At a minimum, it’s going to take the Treasury several days to walk through the financial numbers and gather all the facts before it takes any action. The Treasury wants to see the cash-flow data and get to the truth about GM and Chrysler. (Ford doesn’t need the money.) And nothing will happen until these numbers are properly crunched. And the Treasury may well want to arrange for a built-in monitor — something that might even look like a car tsar — if any TARP money is dispersed.

Senate sources tell me that any TARP-money allocation might include the very same conditions proposed by Tennessee Sen. Bob Corker in legislation that broke down in a marathon session in the Senate list night.

Taxpayers are being asked to bailout the industry on the condition it becomes genuinely competitive so that future bailouts are not needed, and the UAW agrees, except for the part about becoming genuinely competitive so that future bailouts are not needed.

As the American taxpayer is essentially being asked to step in and become part of the companies' management, we have the right and duty to drive as hard a bargain as possible. We need full value on our money.

I hope this is true. Can they force concessions on the UAW? I don't like this bailout at all, but if Bush is going to cave and use TARP then including the Corker stuff is at least a a small, barely perceptible silver lining. Plus, if it prompts more whining from Gettelfinger I'm all for it.

What really needs to happen, I mean really needs to happen, is for someone to explain why a federal bailout with restructuring conditions is better than letting the companies restructure under Chapter 11.

Running around crying that 3 million jobs will be lost if the industry fails does not cut it. Restructuring does not = the disappearance of the industry. So anyone supporting the congressional bailout package or the new TARP bailout proposal needs to explain why a bailout is necessarily better than restructuring under Chapter 11.

As the American taxpayer is essentially being asked to step in and become part of the companies' management, we have the right and duty to drive as hard a bargain as possible.

Explain how the American taxpayer/government "essentially becoming part of the companies' management" is not socialism.

From the way it sounded to me, the biggest advantage to the bailout as structured by Corker is that the debtholders only take it in the mouth and not in the ass.  Under Chapter 11, the debtholders could be left with nothing.  That's not good for an already shaky economy.

30 Ford's the only one that's managed to stay somewhat solvent.  Not exactly as competitive and solvent as it could be, but at least enough to manage.  Certainly heads and shoulders above Chrysler and GM (and also add that both my Ford truck and little put-put mobiles were the only domestic cars I or my family have owned in the last 40 years that actually, on average held up decently well -- the Dodges have been hit and miss although when good very much so, the GMs so horrid to swear off them forever).  Why is that?  Twould be an interesting case study into this whole fiasco I think.

Because Ford has been having problems for a much longer time. Remember the Explorers that kept rolling over and killing people? They've been going through financial problems for quite a long time, then got rid of Bill Ford Jr. and hired a competent executive. They knew there was no chance of a bailout 5+ years ago, so they hunkered down and figured it out. And they're kind of OK. Right now, GM and Chrysler are where Ford was years ago.

I believe you are thinking of a Chapter 7 bankruptcy which basically dissolves the company. Chapter 11 requires debt payments, but reduced and restructured, as I understand it. They want to avoid bankruptcy because the unions could be forced to renegotiate with absolutely no leverage and almost no way to avoid looking like the bad guys if they refuse a contract.

And yeah I don't mind Rahm Emmanuel telling a reporter to go to hell in those circumstances. He should, I would.

Although I do have to add, one of the politicos in MI, after screaming bloody murder about Republican Senators in the south, did indeed mention that some (mumble, mumble) Democrats did vote against the bill.
