| Illinois AG asks Judiciary to Remove Blagojevich UPDATE: Chief Of Staff Resigns![]() Atty. General Lisa Madigan called on the Illinois Supreme Court today to temporarily remove Gov. Rod Blagojevich from office and appoint Lt. Gov. Patrick Quinn as acting governor, "so the business of the state of Illinois can go forward." Madigan said she wants the court to bar Blagojevich from directing state contracts along with a broad range of state business. One of her goals is to prevent Blagojevich from using his power to appoint a U.S. senator to replace President-elect Barack Obama, who abandoned the seat as he prepares to enter the White House.Ed at Hot Air says this is a the wrong approach, arguing it's the legislature's job to remove the governor, not the judiciary's. It looks as though the legislature is preparing to do just that. Since the governor was elected by the people, the representatives of the people should be the ones to end his political career, not the courts. Just to add a little bit of fun to the ongoing story, an attorney from the Heartland Institute writes in the Chicago Tribune that the case against Blagojevich is "legally doubtful." Enjoy. The other thing I heard was that the IL legislator was going to remove him and call for a special election. Since that would have given the Republicans a chance to pick up a seat they couldn't have that.

I agree with Ed at Hot Air - the judiciary is the wrong approach. There is no constitutional reason why impeachment and removal would take so long. Here is what the Illinois Constitution says:
SECTION 14. IMPEACHMENT The House of Representatives has the sole power to conduct legislative investigations to determine the existence of cause for impeachment and, by the vote of a majority of the members elected, to impeach Executive and Judicial officers. Impeachments shall be tried by the Senate. When sitting for that purpose, Senators shall be upon oath, or affirmation, to do justice according to law. If the Governor is tried, the Chief Justice of the Supreme Court shall preside. No person shall be convicted without the concurrence of two-thirds of the Senators elected. Judgment shall not extend beyond removal from office and disqualification to hold any public office of this State. An impeached officer, whether convicted or acquitted, shall be liable to prosecution, trial, judgment and punishment according to law. What I want to know is when does Balgo announce he was actually running an investigation himself? Everyone says he knew he was under investigation so he would have to be stupid or crazy to do this. He should say he was trying to lure out some scumbags himself. Either that or claim entrapment. If you are talking to reps of the President elect and they don't say anything it would be reasonable to assume it's not wrong and proceed. The judiciary is the wrong approach because (a) there is already a legislative remedy in place for what to do, i.e., impeachment and removal, and (b) we just need to stop looking to judges to solve our problems for us.

I believe this was just Fitz's way of saying he wanted to be Senate Candidate #6 and he wasn't bringing a suitcase of cash, he was bringing a baseball bat.
The interesting thing is the easiest way to tie this up as a Federal case is to tie it to Obama. If no one wants that to happen, except us fetid right wing bloggers, then the case has to go away or be picked up by Madigan at the state level. An outright dismissal would embarrass Fitz and the courts, Fitz dropping the case at this point would be baffling, so how to get out of it ... appoint Fitz - he has to drop the case as a conflict of interest and it goes away for a while. The judiciary does not have the power to remove the governor, it only (maybe) has the power to temporarily stop him from doing some bad things. Like selling Senate seats. Did you guys watch the press conference? She's in favor of the special election. Further, the judicial action is temporary, so if the legislature fails to act, Blago could be backe in charge next year some time. It seems a better alternative than letting him sign bills and hand out money between now and when the legislature can act and then sorting it all out.
The best part of the conference was when the lawyers explained to local liberal media that the legislature trumps the judiciary, as soon as they act. I thought Andy Shaw's head was going to explode. In any case, this is going to be popcorn worthy for a long time. Blago's not going to spend the rest of his natural life in prison if he's got any dirt to sell. It is the first time in Illinois history that such an action was taken. The attorney general is applying a rule that was intended to cover cases where a governor is incapacitated for health reasons. Her motion indicates that his inability to serve because of the scandal is akin to a debilitating health issue. No fucking way should the court allow this. That has to do with legal culpability, i.e., court proceedings, not the court of public opinion. Even IF a determination were to be made that Blago committed no crime, he's still operating his office in a reprehensible manner. Before buying in too much to the opinions of the Heartland Institute Attorney, you might want to also read Andy McCarthy's take. Yeah, he's a friend of Fitzgerald, but he also has the advantage of having actually worked for the Justice Department, and understands what it is Federal Prosecutors do, and why.

Jean @ 47, I read it. They have a teensy-weensy point. They argue that the feds should butt out of what is essentially a state-level bribery scandal. And in Ideal Federalism Land, I'd agree with them. But the entire reason why the feds have laws against state-level bribery is because in our past, entire states would be run by corrupt political machines. Think: Louisiana. Or Alaska. So I'm totally okay with making an exception to strict federalism when it comes to corruption even at the state level. Besides one can also argue that since the corruption involves selling a federal office, that the feds are merely preserving the integrity of their own institutions, i.e., the US Senate, by going after state-level corruption.

Jean, you might want to check that word "precipitously." Imagine for a moment that Blago sold the seat. Then it comes out that he sold it and Fitz had him on tape doing it, but waited for the case to mature. Now instead of arresting one POS governor, you have to arrest a sitting Senator who may well have already cast votes. Now imagine that one vote allowed cloture on the auto bailout to pass. And wait a few more days when funds have begun to be dispersed. Now try to figure how that mess gets unscrewed.
As much as I would love to have Obama on tape himself in this matter, I'd rather investigators prevent crime when they're in a position to. Blago will squeal. Then those he sells out will squeal. And it will go on for a good long time. Even if Obama can't be nailed down, the entire Chicago machine will burn in the process. Jean, that's the thing. There was talk last Sunday that Blago was 'very close' to making a decision. I don't know how much of a process naming the replacement is, beyond holding a press conference and signing some paperwork. I think that replacement would already be in DC today had Fitz not acted. I forget where I read it, but Blago told someone that he wanted to name the replacement soon, so he/she would get seniority over those who were elected this year.

If the legislature is neglecting its duty, or cannot move fast enough, but the combination of the executive branch and the judicial branch are able to move quickly and justly, then I think it is a good thing and not power-grab that ignores the separation of powers.
