| Shocka...People Who Defaulted On Their Mortgages Did So Again After It Was RestructuredIt's almost as if they don't have enough money to support the size homes they purchased or something. "The results, I confess, were somewhat surprising, and not in a good way," John Dugan, head of the U.S. Office of the Comptroller of the Currency, said in prepared remarks for a U.S. housing forum. "Put simply, it shows that over half of mortgage modifications seemed not to be working after six months." Dugan said based on data collected from some of the biggest U.S. institutions, like Bank of America [BAC 17.09 1.85 (+12.14%) ], Citibank [C 8.17 0.46 (+5.97%) ] and JPMorgan Chase [JPM 35.46 2.11 (+6.33%) ], home foreclosure starts fell by 2.6 percent in the three months ended in September. ...Dugan said recent data showed that after three months, nearly 36 percent of borrowers who received restructured mortgages in the first quarter re-defaulted. The rate of re-default jumped to about 53 percent after six months and 58 percent after eight months, Dugan said, without providing an explanation for the trend.Hmmm, why might people continually default on their mortgages? It seems to me their are two broad categories of choices. First, they bought homes too expensive for their income and thought they could keep taking cash against their home's 'value' or that real estate price would go up forever and they could sell for a profit before their rates went up. Now that the music has stopped they don't have a chair, just a home they can't afford under just about any conditions. Or second...Bush, Cheney and the Evil Bankers held a gun to their heads and forced them to take a mortgage they knew they could never afford. Third option: A lot of loans were given to turds who couldn't be trusted to finance a candy bar with 50% down without government promises. A lot of those people are boges. They buy their cars from note lots, all of their credit cards are maxed out and probably in collection. Their entire credit history has been one of slow pay or no pay.

@1, have a friend who was in Real Estate. He had people showing up with pre-approved loans whose annual payments were twice their annual income.

I don't own my own home (I was saving for the day the housing bubble broke and I could afford one at a reasonable price - with every bailout and price prop, my hopes are fading). Anyway, I am trying to convince my parents to default on their home. It was mostly reasonably-priced (maybe a smidge too high), but well within what they could afford and in area that didn't see the huge run-ups of, say, California. Defaulting on their Citi mortgage just makes sense; they may get it free and clear or they may be able to negotiate the principal even lower. And Citi just got $8 trillion of tax money; they're not going to be hurt.

This is indeed a shock. We have all assumed that predatory and unscrupulous mortgage lenders and corporate robber barons forced these innocent consumers to abandon their formerly contented circumstances with the lure of their fancy houses and legal fine print. Now we find out that even if the print were in a reasonable font and normal English, people still can only afford 25% of their monthly budget for housing.

There is a fourth category and I fall into that small sector. Rising personal outflow costs, in our case immediate and necessary medical costs caused our cash inflow to no longer be sufficient. However those few that fall into this category DO NOT want a bailout. I refuse to declare bankruptcy or get a handout cause if I have to lose my home then so be it. I have my wits and the ability to re-gain all that I have lost so I WILL NOT receive charity that I do not deserve. This is a problem that I incurred due to too much faith in what I could overcome, what was happening to us at the moment and that all would itself out sooner than it did. I now work 2+ jobs (I am in the National Guard and do not consider this a part time job, but an honor, does pay some though). I don't say this for sympathy, in fact if any of you morons give it I will fart in your general direction! I just say this because some ( a very select few it appears) still have their honor and accept personal responsibility for their actions and will accept the consequences of their actions. This quality is what made America great and I refuse to belive that this quality is completely dead in America. Recovery is hard but very doable with grit and determination. Fortunes come and go as they say. I will have mine again soon.

I've defaulted on my home mortgage loan no fewer than five times in the last three weeks. I'm quick. I just can't scale back on my living space that I need. They used to have a pretty simple rule. The most you could get for financing was based on a payment which when the taxes and insurance were added in did not exceed 1/3 of your gross income. The only way around that was with 20% down. Why? Because if you were able to save that much money you must be pretty responsible and having that much cash invested did a lot to insure you wouldn't just walk away because the values fluctuated. Did that leave a lot of people out in the cold? Yes, but it was still a good rule, kept things solvent and it takes pretty much the other 2/3s of your income for expenses, taxes and a little savings. The solution was to build more affordable housing, not just give loans for any amount. By affordable housing I don't mean projects either, just some that happen to be 1200 square feet instead of 2400.

Not bad credit. NO credit. Never used cards, went to school on scholarship and fellowship, paying for current MA out of pocket, as I go. Paid cheap for old, reliable used cars. So getting someone to give me a loan is going to be a problem until I can accumulate (and service) some debt. 2) Housing prices aren't falling quickly enough. I really thought that when this all shook out, I'd be able to afford a small (like 2br) house in a decent, older part of town (nothing stylish, just folks.) Not even close. I'll never be able to afford one at this rate. And I'm loath to save more, what with the serious inflation that we're going to get right after the economy DOES turn around.

Jdub, Just apply for some cards, A Visa and maybe some store cards like Home Depot or Sears. Unless you credit is terrible they will give you one, it just may not have much of a limit. Just make sure there is not yearly service fee for the card. Use them, even for small purchases and pay it off each month. Right on. People forget that this style of borrowing -- merely using credit cards as a substitute for cash you already have -- was why they were created in the first place. Simple rule: if you can't afford to buy it by the end of this month, don't buy it, and especially don't put it on the card. Modification to the simple rule: If you're going to use the card to buy something you can't pay for by the end of the month, buy it, and then leave the card in a safety deposit box at the bank. Basically, it seems like everyone who plays by the rules and pays their bills is going to get totally screwed in the non-life affirming way. Look, it's one thing for someone who is in #9's position to attempt to work out something with the bank to allow them to get back on track. That is being responsible and is probably better for the lender as well. I'm not suggesting going into debt. If you buy a hammer for 12 bucks at Home Depot, charge it to their card. You can pay the charge right afterwards at the same register if you want to. It counts for a credit history. My mother-in-law charges everything she buys to here VISA, including groceries, to get cash back bonuses, etc. She just pays it off each off each month. The nice thing about having the cards is, especially from stores, they send you coupons every month of like 10% off any purchase. So you save there too even if you don't charge it. I have so many store cards it's ridiculous. i got them because they give you 10% off your first purchase. I then pay it off and cancel the card or keep it if there are no rolling charges. You just need to be disciplined but you sound pretty disciplined already. Forget the credit is available, just don't spend more then you normally would. Simple rule: if you can't afford to buy it by the end of this month, don't buy it, and especially don't put it on the card. I don't think most people need to be that uptight about credit. There have been several times in my adult life when I've had a credit card balance. Sometimes my expenses have gotten ahead of my income. It's never been a problem to pay it off within a few months. Yes, there are some people who can't control it, but most people can. Yes, it is risky if you lose your job and/or don't have any savings to fall back on. The other nasty little kicker is that the 1/3 rule of thumb may be too high. In NY, when the state gets squeezed, more of the madates we get from Albany are unfunded, or state aid to school districts gets cut, or... Well, those expenses don't go away, they just show up in your property and school tax bills. I've seen them jump more than 10%. You don't expect the state to lay workers off, or cut their expenses, do you? My point is that you need a cushion over and above what is affordable to you, even if you keep your job, put down 20 percent, and really can afford it. We always use our AMEX to pay, then immediately pay it off when we get home. We get points on our card, and we don't pay interest. Of course, this can cause problems. We tried to purchase something big on the card a while back. The company flagged it as a suspicious transaction since most times we use it the total is $200 tops. They saw a whole bunch of little transactions versus a big one. Instead, we used a different card issued by the same company that we never use for anything. It went through. Expanding on Rocks' suggestion, I'd recommend getting a "cash back" card (cards like the Chase Freedom give you 1% cash back), and treat it like a checking account. Every time you charge something, treat it like you wrote a check. Don't charge anything if you would "bounce" a check -- if your accumulated card balance (which you update on *every* purchase) exceeds your checking account balanced. Not only does this technique give you some credit history, but also an effective 1% discount. Additionally, because your charges don't come out of your checking account until the next cycle, you might get a little bit of extra interest if you have a interest-bearing checking account. You just need to be disciplined but you sound pretty disciplined already. Yeah, this does take discipline that too many people lack. But if you survived the past 10 years without getting a credit card from all of the utterly irresponsible lenders out there, you're plenty disciplined! I got laid off about a month ago, I worked for a company that bought and traded mortgage notes on the secondary market. We would value performing, high credit notes at about 75 cents on the dollar. We analyzed millions of dollars of mortgages and their payment history. If people have no money in the transaction, their is nothing keeping them from walking away. The Market says otherwise. The Market, spurred by the Federal Government, said everybody could buy a big home. Builders, being capitalists, go where they can make the most money. I can tell you that requests for bids for multi-family and duplex units is going up dramatically. Rental units, which were in the decline for the last seven years is going up. I bought my 1705 sf home for $63,000 in 2001. My morgtage and escrow pmt is $619 per month. My net income varies between $6400 and $8000 per month. I'm pretty sure that Fannie and Freddy both are calling me a dumbass behind my back.

I don't blame the builders really. If it costs 100,000 to build a 1200 sq/ft house you can sell for 200,000 and it costs 150,000 to build a 2400 sq/ft house you can sell for 400,000 then only a fool would do otherwise. It's up to the town to promote affordable housing through zoning, especially when they sell public lands. They don't because they get more taxes from the bigger house too. But without affordable housing assholes like Dodd and Frank will push for CRA, etc and look where we end up. Lending people more than they could afford to pay for twice the house they needed because that was the cheapest house available near their work.

It's only going to get worse over the next two years. Everybody who bought with mortgages adjustable after 5 years, at the peak of the market in 2004-2006, is going to be in for some massive sticker shock. When these mortgage resets in 2009-2011, all the mortgages than people CAN afford to pay now will become unaffordable. With all of these houses now worth less than what those people paid 5 years earlier, there is no incentive for these people to stay in their homes. It will become economically intelligent to walk away from the home. The resulting foreclosure will drive prices in the neighborhood down, prompting others to walk away too. This snowball will become an avalanche.
I'm a prime example. My house is worth less than HALF what I paid for it in 2005. I can still pay the mortgage, and I'll even be able to afford it when it resets in 2010 (I planned ahead as a responsible borrower). But in 2010, why should I pay double the cost of renting the exact same place, on a home that is worth only half the mortgage? It does not make any sense. Jdub, You need to get a credit card that pays cash back, charge everything on it and pay it off at the end of the month. Essentially they are paying you money to use their card and not getting a penny from you. That is what we do, charge on the card all month and then pay it off at the end of every month and never paying an interest payment. And they give me money for doing that, how sweet is that! Ten years ago, I fucked up my credit. I had a $15 balance on a credit card and forgot about it ... for three months, when my card got cancelled. I paid the bill, but couldn't get another one. I also was more than 30 days late about eight times in four years, and had about another four late payments. I was pretty much broke at the time, but working, and was living as cheaply as I could. But my income sucked. Anyway, from that lesson I learned about credit -- pay on time, pay on time, pay on time, and everything flows from that. Only borrow what you can pay on time, keep the balances low, use Amex, pay on time. About four years of paying every bill on time and increasing my income, I called the bank and asked if they might please send me a credit card. They offered me $6k. Zip forward to today, my credit score is over 800. Granted, I did some crazy shit to get the score that high -- like taking out massive cash advances because I knew a loan was coming through, then paid off the CC balance with the loan, then flipping a piece of land to pay off the loan. When you've paid off $15k of credit card debt within a month or two on three separate occasions, the bank believes you'll pay back whatever you say. Bottom line: You don't need a lot to get good credit -- just borrow what you can afford, even if it's just a little bit, and get those checks in on time. FWIW.
