| Nuclear Option: Franken Laying Predicate for Senate to Vote Him Into Office Even if He Loses the Vote?Franken's behind by 340 and almost guaranteed to lose the recount. He's going to be behind by enough that even his demands that dubious absentee votes be counted won't save him. A reader explains why the secretary of state's site shows Franken behind: Simply because the recount isn't finished yet, and many of the uncounted precincts went big for Coleman. So the current tally is not reflective of the likely final tally. So is that it for Franken? No. The Senate can simply vote him into office if they so choose, and Franken's spurious arguments about "uncounted votes" may be an effort to give them the pretext to do just that. In 1975 the Senate refused to certify the victory of a Republican who'd won in New Hampshire by two votes. Ultimately a compromise was reached -- a new election-- which the Democrat won. The only thing that can prevent this is a filibuster... which may or may not be available to us, depending on today's vote in Georgia. And even a filibuster would only block the Democrats' attempts to seat Franken -- it would not get Coleman certified as the winner. Similar: Powerline agrees Franken is lobbying Reid for just this scheme. Another 171 Ballots Suddenly Discovered: Oy. They're from a swing district, so ought not to break heavily for Franken (Captain Ed guesses an 11 vote pickup based on district breakdown). I'm less sanguine. We will see just how ballsy the dems are. If they try to put the loser Franken in office despite losing an election the backlash will start early. Prediction - the American people will be tired of the Obama administration and the congress by the end of 2009. Some in the press will try to regain some credibility by actually doing their jobs and pointing out the mistakes of the Chosen One and his minions. I thought they would do this but after thinking it over more, it's just so in your face and could really hurt more than help. This thing has gotten way to big for something so brazen that still may not give them the super majority anyway. It's a pretty big risk with all eyes watching the race.

Agreed with #6. My attitude will be that every act passed by a Senate with a Franken in it (assuming he loses a recount that was conducted in a manner consistent with Minnesota law) will be a "fruit of the poisonous" tree, possessing no legitimacy and not requiring my acceptance to it other than whatever physical coercive force from the state (threatened, implied, or actual) may enable.

Nevermind the filibuster. Republicans, even in the minority, have the ability to essentially shut the Congress down if this "appointment" happens. No continuing resolutions. No consent. No yielding floor time. There are many ways to bring the place to a halt. The GOP really will have to go nuclear if this happens. The result of the run-off election in Georgia will dictate what happens with Franken. If Chambliss loses then it puts extra pressure on the Democrats to back Franken and get the magic 60 vote supermajority. If Chambliss wins then the Democrats can't get their supermajority and they'll just stay out of the recount mess. With a win by Chambliss there is no upside for them to stick their noses into the recount. It will just look bad and give the Republicans an issue to run on in two years. Besides, a lot of the establishment really Dems don't want Franken in there anyway. If he gets in, it may set a precedent for other Hollywood stars to do the same thing. They don't really want Sean Penn, Tim Robbins, Michael Moore or any of the others running for Congress.

I think it would be funny if that happened. It would simply confirm how much Hollywood is in the bag for liberal causes. It'd probably be tempting, since they then wouldn't be required to string along those useless idiots anymore. They could rely on the Democratic PR Department (MSM) to spin everything they do in such a positive light, hoping that by the time midterms and 2012 rolls around everyone but the people of Minnesota stops caring about it. They got their template for running elections this year to try again (Disabled AVS for online donations, etc.) So while you're right in assuming that its a boneheaded move, don't put it past them to be considering it. It's not going to happen. The last thing the Democrats want is the legitimacy of what the government is doing called into question. If people were to actually read the Constitution, they'd quickly realize that most of what is being done to them is illegal. Franken isn't worth the heat.

The Congressional Dems are split between the true believers and the pragmatists. The True Believers want the supermajority at any cost, even if it means tolerating Al Franken. The Pragmatists know they have the Congress and the White House. With the country in a recession and a lot of uncertainty going into the next Congress, the Pragmatists want a fall guy. If things go well they can take the credit, if things go badly they can blame the Republicans. If the Democrats have a supermajority. They won't be able to blame the Republicans.

The Rules of the Senate require a two-thirds vote (67) to be amended. The Senate is a continuing body, unlike the House (since two-thirds of the membership carry over without election), so it does not readopt its rules at the beginning of each Congress. The only time the Rules get changed are for things that are totally uncontroversial. Therefore, there's no way that would ever happen. "No continuing resolutions. No consent. No yielding floor time. There are many ways to bring the place to a halt." The quickest way to bring the Senate to a halt is this: whenever any piece of legislation is introduced, the clerk reads the title ("First Reading") and the sponsor moves to dispense with further reading of the bill, to which there's invariably no objection and the chair finds unanimous consent.
