| Good Lord: Woman Falls for Nigerian Email Scam to the Tune of $400,000Don't feel bad for her. Feel bad for her husband. It was his retirement account she squandered -- even after being repeatedly informed it was a scam and she needed to stop sending money. An Oregon woman who is out $400,000 after falling for a well-known Internet scam says she wasn't a sucker or an easy mark. Janella Spears of Sweet Home says she simply became curious when she received an e-mail promising her $20.5 million if she would only help out a long-lost relative identified as J.B. Spears with a little money up front. Spears told KATU-TV about the scammers' ability to identify her relative by name was persuasive. "That's what got me to believe it," She said. "So, why wouldn't you send over $100?"If someone can successfully toss out a name that may or may not be a relative (and may or may not even be a living person), why wouldn't you believe him? Spears, who is a nursing administrator and CPR teacher, said she mortgaged the house and took a lien out on the family car, and ran through her husband's retirement account. "The retirement he was dreaming of — cruising and going around and seeing America — is pretty much gone for him right now," she said.It's gone for him right now? Unless her husband is actually Bear Sterns, I'd say it's gone forever. ... Her family and bank officials told her it was all a scam, she said, and begged her to stop, but she persisted because she became obsessed with getting paid. ... The scammers sent Spears official-looking documents and certificates from the Bank of Nigeria and the United Nations. President Bush and FBI Director Robert Mueller were also involved, the e-mails said, and needed her help. ... "The hope is [other people] are not going to fall as hard as I fell," Spears said.Little chance of that, lady. There was something here in Washington state (and maybe elsewhere?) a few months ago about crooks targeting older people, they'd find out the names of the teenage grandkids and then call up and tell the grandparents that they were in trouble and needed some money and didn't want to upset their parents so could the grandparent please help out. Some people fell for it and wired money.

I know an elderly gentleman who fell for this same type of thing, but it was couched in the 'you've won the European lottery!' wrapper.
After he wrote them back with questions, these people started calling him at home and emailing him. These bitches talked to him like he was their grandfather, patiently explaining how they needed money to get his winnings through 'customs' or some other unlikely shit, gently wheedling several thousand dollars out of him at a time. Yes, they are evil; but they wouldn't be able to do any of this shit if people weren't greedy. He was greedy and that greed made him want to believe in the undeserved magical lucky windfall. I had a co-worker several years back who piddled around with raising cattle on the side. He had a section leased about 15 miles out of town and had 28 cows and a bull on it. He managed to get his ass fired and had to move on down the road, and where he ended up he couldn't lease any range, so he sold the cattle and put the money in his joint checking acct until he could arrange for some land and start a new herd. About a year later he signed a lease on a section outside of his new hometown and went down to the bank to get his money so he could go to the sale barn and it was gone. His wife had bought herself about $30,000 worth of clothing and home furnishings that year and he never even noticed. So he had the expense of a years lease of grass w/o the capital to put even a single head on it. I can't believe he told me the story. That's one I would've kept to myself. His son ran for the Texas state legislature a couple of years ago and came within a cunthair of getting elected. I'm pretty sure he took after his mama when it came to money management. I fucked with one of those guys on the Nigerian end for a couple of weeks, he then threatened to have me killed. I said bring it on dirt eater. The Nigerian crime lords have moved their shills who bait people to the tiny nation of Benin. Benin laws are more lax since the US has pressured Nigeria into cracking down on these scams.
Many have moved from the "lottery" or "oil revenue" schemes to less complex scams on sites like myspace and facebook, as well as personals sites in an attempt to sucker lonely people. Since the GNP of Benin is like $1500 a year USD, hitting someone for $500 is a very lucrative deal for them. A common red flag is from one who says they are in say Virginia, yet list Chicago as their hometown. The scam is to find a mark who lives in one of those two places and then request $500 for a plane ticket to come for a visit. Brought to mind a conversation I once had with some federal agents who had attended a conference on West African crime. Apparently the reason Nigeria is one of the very top providers of peacekeeping troops for UN missions (I think it was #2 as of a couple of years ago, right behind Uruguay) is so that scam artists in the guise of soldiers can go and work their magic in foreign countries where they are assigned.

That's an affirmative defense, SarahW. I have said repeatedly if the defense can demonstrate it it should be taken into consideration. They would have to show this mental defect -- if any (all you've done is quote some generalized study; you haven't proven it in her case) rose to the level that she was incapacitated and/or unable to tell right from wrong. Don't say I haven't said that. I've said it at least 3 times already. However, the law doesn't accept routine compulsions as excusing someone for crime. To use a wholly different crime, I absolutely accept that rapists feel compelled. So do child molesters. Shoplifters. Joyriders. Streetfighters. Many of these even have demonstratably different organic differences, like higher testestorone levels -- a predictor of violence, sexuality, and risk taking -- and even brain scarring from previous violent encounters. Anecdotes don't mean much. There's a similar process that happens in stroke victims, but the odd thing is it really depends which side of the brain is injured. One side causes extra anxiety, worry, and fear about, say, a new deficit in function. Same thing happened to another elderly woman in an assisted living situation. Got a call, gave all her info, the people even flew down from canada (ahem) to complete additional transactions, and the old lady no longer had the money to afford a place to live. I know a little bit about fraud on the elderly (I used to work in the telemarketing sector and while I did honest work for decent companies, I knew a few people -- by far the minority --who had previously worked for scammy Canadian telemarketing "lottery" companies defrauding American seniors). Those people were vultures who should have, and occasionally were, put in prison. Certainly I despised them. However, being the victim of a financial crime doesn't give one the legal justification to start committing financial crimes yourself in an effort to recoup your losses. Unless you meet the legal tests I discussed above. Now the prosecutor, probably with the consent of the victim who understandably loves his wife, has exercised their discretion and I'm okay with that. In the end, though, the prosecutor does not serve the victim (not primarily). S/he represents society at large, "the People", and society has an interest in punishing and deterring people from stealing money from their loved ones to recoup their financial errors. But my own mother asked me to go to the casino with her the other day and I said no. That pissed her off because it's her thing. Why did I say no? I went to the casino 3 times in my life and each time I was totally out of control. Twice I lost everything I had, rent money and all, and once I gained before they closed and kicked me out. It triggered some sort of switch in my head not everyone has. Fear, excitement, desire for gain. Whatever. That was a decade ago. I don't do that anymore. I've learned. Some people have gambling problems way worse than I. Just work at a convenience store and watch desperate poor people spend their money on instant lose lottery tickets, buy more with their meagre "winnings", and walk out of 7-Eleven with no money after they get their welfare cheques. It's enough to break your heart. I'm sure these people have self-control and compulsion issues. That said, they cannot legally break into a car and steal a stereo or raid their grandma's purse.
