Ed says now is the time for Stevens to resign.

No, six months ago was the time for the now-convicted felon Stevens to resign.

Now is the time for the convicted felon Stevens to promise to resign on his first day of office so that Sarah Palin's successor as governor can appoint a Republican in his place.

He won't do that, of course. But he'll be ejected quickly enough anyway.

9 Well, if Sarah is still the governor after January 20th, the obvious successor to Stevens would be Sean Parnell whom she supported in the primary to unseat Rep. Don Young. Of course, she could also appoint herself. I don't know how well that would go down. I think she is better off staying out of DC until she can come back with a big stick and clean house.

It would definitely be Palin who would appoint Stevens' replacement. The new Senate will be installed a couple weeks before she will take the oath as Vice President. So she can just wait to resign from her job as Gov. after Stevens is sworn in for his new term and then quickly resigns. Palin will then appoint Sean Parnell as Stevens' replacement. Parnell will then have to resign as Lt. Gov. and

Palin can appoint a new Lt. Gov to replace Parnell. Then Palin can resign and her handpicked successor can take the reigns as Gov.

23 There has to be a special election in Alaska to elect a new Senator. There's no appointment process.

Here's the statute:

Sec. 15.40.140. Condition and time of calling special election.

When a vacancy occurs in the office of United States senator or United States representative, the governor shall, by proclamation, call a special election to be held on a date not less than 60, nor more than 90, days after the date the vacancy occurs. However, if the vacancy occurs on a date that is less than 60 days before or is on or after the date of the primary election in the general election year during which a candidate to fill the office is regularly elected, the governor may not call a special election.

I should clarify that there's an appointment if/when Stevens resigns or is kicked out of the Senate by a 2/3 vote, but the appointee can only serve for up to 60 days until someone is elected.

So if the seat is safely Republican, then it doesn't matter if Mr. Ted "all of these freebies are really just loaners" Stevens is re-elected and then there's a special election, or if his name is used as a proxy, that person wins, and then proxy boy is re-elected in 60 days.

But if the Democrat wins, they keep the seat. Obviously. Morons.

32 I live in Alaska and am a long-time Republican - DO NOT automatically assume that Stevens will be defeated. He is extremely popular here and his opponent has a lot of baggage of his own.

Mark Begich has never run for statewide office and is not that popular in this city. And there were several articles that appeared over the weekend that shed a lot of light on Begich's shady connections to some real estate developers and some questions about his reporting of profits. There is also a matter that will go before the Assembly tonight; as mayor, he modified some muni contracts without having the Assembly review them. As an example, he approved allowing city Police officers to drive patrol cars 30 miles outside the city limits as take-home cars.

One other point: Pollsters here are notoriously inaccurate and are usually 6-8 points high for Democrats. 2 years ago, they had Sarah Palin narrowly ahead; she won by 10 points. They had Fran Ulmer leading Murkowski; he won by 17.

Here's a possibility: Stevens wins, Palin loses. Bush and Senate leaders convince him to resign in exchange for a pardon. Palin runs for the seat in a special election and wins easily. Republican Lt Gov. Sean Parnell, who lost in the primary to Rep Don Young, moves up to Governor of Alaska.

If Sarah wins? Same scenario only perhaps someone like Gary Wilken or John Binkley runs for the seat.

Stevens is 84 and he has a lot of friends in this state. Do not count him out just yet.

33 BTW, there has to be a special election if Stevens resigns. Open seats used to be filled by the governor appointing someone - which is how Stevens got into the Senate to begin with. He lost in the '68 primary but then was appointed by Gov Wally Hickel in Dec '68 when Senator Bartlett died in office.

That policy was changed when gov Frank Murkowski appointed his daughter to fill the vacancy created when he resigned his Senate seat to take the Governor's office.

Yes, he replaced himself with his daughter. By all accounts, she's done a terrific job but nobody liked how it was handled.

It's a special election held 60-90 days after the seat is vacated. The seat remains empty until then. No law I know of to recall him, and that would be a constitutional battle anyway.

Stevens is dirty and has to go, but his conviction kinda feels like the Martha Stewart, Scooter Libby, and Al Capone trials... get 'em on whatever you can, not necessarily whatever the real bad stuff that might have happened. (Granted, I think martha and scooter were sacrifices to assuage the volcano gods). Redirecting millions to his buddies? No, they get him on discounted home repair.

39 The prosecution made a bunch of mistakes and I would bet this case would be overturned on appeal if Stevens lives that long. It looks to me like the jury decided early on that they were going to convict and didn't really care what the testimony said. Here's an example:

Stevens was found guilty, count 4 I think, of not reporting the gift of a dog. Not a carving, an actual breathing dog. The dog was donated to a charity auction and a buddy of Stevens', Bob Penney, bid $1,000 for the dog. He didn't want the dog, just wanted to make a donation to the charity but now he had the dog - so he gave it to Stevens as a joke. Stevens took the dog to DC and then bought one of its brothers from the dog musher who bred them both. He paid $250 for the second dog and then decided it was too much trouble to have dogs in DC so he sent both dogs to Dave Monson, Susan Butcher's husband - and he sent along a check for $500 to cover the care for these dogs. Iditarod champ Dean Osmar testified that the dog was worth no more than $250, which is what Stevens paid for the brother.

So how much was this "gift" worth? The $1,000 that Penney paid? The $250 that Stevens paid for the second dog, the amount that Osmar testified to? Or $0 since he had to pay $250 to get rid of it?

The jury apparently felt the dog was worth $1,000 since that is one of the felonies he was convicted of.

I doubt Stevens will resign, and he will probably appeal; my instinct says he thinks he is innocent and has been acting in the best interests of everyone. That is how people in power usually justify nepotism and cronyism - 'hey I know this person, and I think they will do a good job, so I will give it to them instead of a neutral selection process'. There is a decent argument behind that approach (knowing the person is capable rather than what a resume says), but regardless of how good a pick it is, it still stinks of corruption.

47 havent seen anything like that... recall something saying that there wouldn't be a special election if there was a primary within 60 days. From what I can decipher from the ballot initiative and elsewhere, the gov could appoint someone until a special election took place (a law that was passed, i think, in 2004, which was the initial response to murkowski). But the ballot removed that power. Now it just remains vacant. Not an expert on AK law at all, so there may be something more recent.

What is interesting however is that the ballot runs afoul of the 17th amendment:
"When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct."

But as far as I know, the ballot initiative is current AK law, and would have to be struck down by the courts before the gov. could make a temporary appointment until the special election was concluded a few months later.
