The New York Times has gone on record essentially claiming that McCain combines the worst social and economic policy features of Adolph Hitler, Pol Pot, and Stalin combined with the personality of Caligula, while also claiming that Sarah Palin has the moral compass of a crack whore and is so lacking in intellect that she needs to be reminded to breathe. Obviously I am paraphrasing a bit. McCain Campaign Manager Rick Davis finally called the Times out by referring to them as a Obama advocacy group and said they should drop the pretense of journalism. So they did with this story yesterday:WASHINGTON — One of the giant mortgage companies at the heart of the credit crisis paid $15,000 a month from the end of 2005 through last month to a firm owned by Senator John McCain’s campaign manager, according to two people with direct knowledge of the arrangement. God I love anonymous sources The disclosure undercuts a statement by Mr. McCain on Sunday night that the campaign manager, Rick Davis, had had no involvement with the company for the last several years. ... They said they did not recall Mr. Davis’s doing much substantive work for the company in return for the money, other than speak to a political action committee of high-ranking employees in October 2006 on the approaching midterm Congressional elections. They said Mr. Davis’s firm, Davis & Manafort, had been kept on the payroll because of Mr. Davis’s close ties to Mr. McCain, the Republican presidential nominee, who by 2006 was widely expected to run again for the White House. Mr. Davis took a leave from Davis & Manafortfor the presidential campaign, but as a partner and equity-holder continues to benefit from its income. No one at Davis & Manafort other than Mr. Davis was involved in efforts on Freddie Mac’s behalf, the people familiar with the arrangement said.The McCain campaign responded this morning by essentially calling the NY Times a bunch of stinking liars: Today the New York Times launched its latest attack on this campaign in its capacity as an Obama advocacy organization. Let us be clear about what this story alleges: The New York Times charges that McCain-Palin 2008 campaign manager Rick Davis was paid by Freddie Mac until last month, contrary to previous reporting, as well as statements by this campaign and by Mr. Davis himself. In fact, the allegation is demonstrably false. As has been previously reported, Mr. Davis separated from his consulting firm, Davis Manafort, in 2006. As has been previously reported, Mr. Davis has seen no income from Davis Manafort since 2006. Zero. Mr. Davis has received no salary or compensation since 2006. Mr. Davis has received no profit or partner distributions from that firm on any basis -- weekly, bi-weekly, monthly, bi-monthly, quarterly, semi-annual or annual -- since 2006. Again, zero. Neither has Mr. Davis received any equity in the firm based on profits derived since his financial separation from Davis Manafort in 2006. Further, and missing from the Times' reporting, Mr. Davis has never -- never -- been a lobbyist for either Fannie Mae or Freddie Mac. Mr. Davis has not served as a registered lobbyist since 2005. Though these facts are a matter of public record, the New York Times, in what can only be explained as a willful disregard of the truth, failed to research this story or present any semblance of a fairminded treatment of the facts closely at hand. The paper did manage to report one interesting but irrelevant fact: Mr. Davis did participate in a roundtable discussion on the political scene with...Paul Begala.While it's good to see a Republican standing up for himself in the press I don't think McCain can really win this fight. The Times can print anything it wants and since it is still considered a highly reputable journalistic organization it will get greeted with the presumption of credibility by most people. Any retractions, if they are forthcoming, will be issued sometime after McCain's death. But the higher probability is that the Public Editor in his role of discerner of truth for the masses will look at the reporting and declare that while it was false it served the purpose of bringing out important questions. At that point we will all be struggling under the yoke of Obama's mandatory universal volunteer service and living off tree bark and saw dust soup so we won't really care. I would think that with the smears on Palin, Petraeus/betray-Us etc. ad nauseum, the public - not the NYT's regular readership in NYC and LA - wouldn't believe a word of this. The McCain Campaign needs to get Republicans picketing infront of the Headquarters of these news organizations Demanding that they stop lying and poppoing for the Obama Campaign. Get a bunch of people out in front ther daily and have them scream shout and demonstrate.

This is when I become convinced that the bar for libel and slander is set too high. Sadly, this probably isn't actionable because the NY Times can weasel out with "well he's an equity holder so we thought" and "we asked people who knew and they totes said that he did so there!" That would be enough to get over the malicious disregard for truth standard.

Actually, the best you'll get from the NYT Public Editor is that the study is true but misleading. It falsely insinuates that Davis got paid, but really only reports that his firm got paid, which Camp McCain does not dispute.

There is no such thing as a "fair comment" clause. The standard for a public figure, established by NYT v. Sullivan, is "actual malice," also defined as "knowledge of falsehood" or "reckless disregard for the truth." You definitely have reckless disregard here, as lobbyists must disclose their client lists by law. I think Davis should sue the effers, just for the fun of it.

I think MCcain & company have done good so far to refute the claims of that bird cage liner for a newspaper. But, I think we just need to get them to move on to framing the discourse, instead of reacting to it. As far as the public getting it, did you hear FOX playing an excerpt from a McCain gathering (believe in Scranton, Pa where McCain was at an Irish American gathering) where a woman from the crowd was addressing the shameful coverage of the media and how sick they (we) all are of it? Problem is, there's just enough truth in the story to make proving actual malice close to impossible in this case. NYT v. That's where ya lost me. My point is that they have managed to obscure or distort all sorts of facts in this campaign, despite their failing business model. Unless you're one of the small slice of the electorate that takes the time to research matters beyond the sound bite/headline world, you would believe McCain is a doddering fool. The smears about Palin seem to be sticking. Even Leno, last night, was making jokes about Palin's Bridge to Nowhere. Yet, as we all know, she really did kill it. It's not her boondoggle, nevertheless the meme is out there and will stick exactly like "Bush lied, people died" sticks to this day among the majority of the people. The MSM could really go overboard and photoshop a picture of McCain taking a briefcase full of cash from Dick Fuld. But they really aren't that stupid. That is my point. And like the paper in Citizen Kane, fabulously wealthy liberals will continue to finance the MSM as their avocation, if it can't make a profit. Hollywood continues to make box office failures that denigrate America, losing money. Are they stupid? Not really. They won't make Hate America pictures exclusively. But they make so much cash they can afford to finance their propaganda. Some like to call the MSM the dinosaur media. Well, even a dying dinosaur can do a hell of a lot of damage. And with every reporter they recognize, have a list ready: "Yes, Elizabeth from the New York Times. Rock Mom, I lived through the closing of the Wisconsin Steel Mill. Obama KEEPS SAYING "mills" but the "Mills" are in Indiana, Wisconsin Steel was the only Raw Steel Mill in south Chicago. Conservatives could have their own studio, cameras, technology and do all of their own editing of their own press conference. I don't think any anchors should be present in the press room, and I don't think there should be any permanent press passes. the passes should be authorized based on individuals, not as in political acceptability , but rather based on the reporter submitting their own request and accepting their own background check. then it's not about NETWORK/newspaper equality, it is FIFS ambition, as long as they, the press passer, meets the background checks. That means better political coverage, cuz you have to be right there to be the First in, which would improve the coverage, because they have to actually pay atention. One thing a lawsuit would do is allow for discovery. If the Times refuses to "out" their sources, I believe that is evidence of guilt and would hurt the Times and help the plaintiff. If the Times outs it's sources, all the better. We'll know who lied, either the sources or the NYT.
