Christoph, you're missing the point. Caesar knew that as soon as he resigned his commission and returned to private life, his enemies in the Roman Senate had plans all laid out to indict him. Christoph, according to Rubicon by Tom Holland (p. 295) it seems that the Senate under Pompey declared Caesar a war criminal (over Gaul) first, and demanded he hand over his troops or be arrested. This was on 1 January 49 BC. On 7 January Pompey declared martial law in Rome, and Caesar's friends like Mark Antony had to disguise themselves and flee to Gaul. That Rubicon thing happened as a direct result of that. Making military policy a retroactive felony would seem to be dangerous, is my point...
