Army Responds To TNR's "Stonewalling" Claim: No One's Keeping Beauchamp From Talking, And You Know That

They also note that no one can force Beauchamp to talk, and that the Army has neither the obligation or right to force him to come clean with TNR.

We are not stonewalling anyone. There are official statements that are out there are on the record from several of us and nothing has changed.

We are not preventing him from speaking to TNR or anyone. He has full access to the Morale Welfare and Recreation phones that all the other members of the unit are free to use. It is my understanding that he has been informed of the requests to speak to various members of the media, both traditional and non-traditional and has declined. That is his right.

We will not nor can we force a Soldier to talk to the media or his family or anyone really for that matter in these types of issues.

In other words: Hey, TNR? If he's "your writer," as you say (rather than "our soldier," which his oath says), you persuade him to talk. Got nothin' to do with us.

This leaves TNR twisting in the wind, which is either an unfair outcome or poetic justice. With Beauchamp apparently unwilling to repeat his claims or say precisely what he told the army, and the army feeling the law prevents them from releasing his statements, TNR can't quite disavow Beauchamp's stories but also can't quite re-affirm them.

Perhaps that's the best outcome it could hope for, and perhaps Beauchamp is actually doing them a favor by not admitting to them he lied. They can thus claim the whole matter is "unresolved," as Dan Rather claims to this day regarding Rathergate.

Then again, he's on HDNet now, so how well did that work out for him?

1 You know, Ace, you're practically a law-abiding American citizen.  YOU could file a Freedom Of Information Act demand for the records of Boochie's hearings and the investigation...

Richard,

Administrative punishment doesn't work like that.  It's all classified confidential and can only be released with the permission of the individual who recieved the punishment, or at some time after his death.

Thats why kerry's records are so heavily redacted.  Other than awards, or CM's, everything in your record book is "Confidential" as in the security code, not as in reporters with sources.  It's against the law to release information absent those two situations.  There are other situations, but those other situations are why scott has his fucking mouth shut.  If he opens his mouth again, that shit becomes open for his court-martial, which is what he actually rates.

6 Ugh. HotAir, or as I like to call them, the Holy Rollers because every body is always trying to force their religion down your throat over there,  have gotten all p.c. about beauchamp.  It started with that same weird guy who felt he had to announce out of the blue that he would never hire Ace because he has a potty mouth. Like anybody fucking asked him! Jeesh! He's a snow-wop, too.

7 I pity Boochie's CO.
That poor commander, besides having to plan anf move his troops into Iraq, has this p.o.s. to deal with.
NJP (Art 15 UCMJ) punishments are not enough for what this Pvt did, but seems for now, they are the commander's only options.
Plus, this commander has to prevent the other guys under his command from beating the daylights out of Boochie.
Yep, I pity the CO.

Posted by: marvin at August 11, 2007 07:46 PM (qY1s4)

8 If TNR is claiming that Boochie has been 'restricted' from talking for the last 15 days....
maybe Boochie has been restricted -- Restriction is one of the punishments that the CO can impose under Art 15 UCMJ. --

Posted by: marvin at August 11, 2007 07:50 PM (qY1s4)

9 Beauchamp's statement falls under the Privacy Act of 1974.  It probably has that blurb at the bottom of the form.  So the Army isn't just operating from "feelings" but from the law.

13 WickedPinto -- ah, but Boochie hasn't even been assigned administrative punishment yet.  Get that demand in while the getting is good!

But seriously, what is Boochie supposed to do now?  All he has is telephone access.  Can anyone imagine a REAL journalist dictating his stories over a telephone line er sumthin?

Posted by: richard mcenroe at August 11, 2007 08:16 PM (lCheg)

14

If none of those three closely monitored calls to family members mentioned in TNR's latest rationalization/excuse was to Boochie's blushing bride, she's likely to be more than a little pissed off now that his cover has been blown.

Boochie phone home.

BTW, this is the second time the Army has said Boochie was free to talk to whomever he wanted.  TNR must have missed the first time, what with their vacation and all.

There is a pre-liminary, non-official restriction that can be placed on individuals, I know I had 45 days of it prior to my SCM, when in foreign country's.  The ONE thing that cannot be restricted is contact via private means.  I could write home and bitch about the corps, which I didn't.  I could call home and bitch about the corps, which I didn't.  Scott can contact whoever he wants, but he dare not, because if he does he's going to offer conflicting statements and get ass rammed because of it.

Even NJP assigned restriction cannot limit contact for the purposes of morale and good will, you have to stay in uniform all day, and check in, but you do not lose your right to be a citizen by making contact absent a threat of security.

20 Dusty, they do have one little clip on the fox site about TNR.

It was irritating because the "five separate witnesses" bit got trotted out again, even though at least two and probably three refuted STB's calculated embroidery of key details....

TNR has at most three witnesses to actual events detailed in the stories, and TNR probably only has the one guy for the whoppers, and some others confirming details not in dispute.

--- BTW, Sorry about previous suggestion for room-clearing above, means to an end, and all.

Posted by: Boochie at August 11, 2007 10:54 PM (JQwWt)

23 See, I guessed that they couldn't release the reports...and SBT knew that, and TNR knows that, and they like it that way. The liberals will keep saying he was coerced and be smug and happy.

Posted by: Aaron at August 12, 2007 12:33 AM (sw8Q0)

24

Here's the next shoe to fall:

After all the media finally figure out that nobody is restricted from discussing this, they will start hounding everyone in STB's platoon/company/etc. as well as their family members/significant others and eventually the ugly details will come out.

Posted by: Dogstar at August 12, 2007 01:39 AM (FgxdU)

25 This means Beauchump is still lying to TNR.

And ironically considering the circumstances he is lying to them about how awful the US military is and they're still buying it without question or verification.

He told his wife he's been restricted from the phones. His wife told Daddy Foer. Daddy Foer parrots the nonsense - Army bad, we can't talk to the poor little mistreated chump.

I am so glad the Army released this statement. If this doesn't back TNR off then nothing will. But regardless of what they do it is undeniable anymore, at least among people with a fucking brain.

26 I'm hoping the Army reconsiders and throws the UCMJ manual at the little fuck.

27 Having just gone through the army IG school in July, I'd say he hasn't been article 15'd yet, and that the IG played a big part in what we know/.

However, results IG investigations cannot be used for adverse actions (at least in the army) so the CDR has to start from square one if he wants to prosecute. It's complicated stuff, but I have oodles of powerpoints from school if anyone really cares how it works
