Bush Commutes Libby's Jail Sentence; Leaves Fine, Probation Intact

"Excessive" sentence, he says.

President Bush commuted the sentence of former aide I. Lewis "Scooter" Libby Monday, sparing him from a 2 1/2-year prison term in the CIA leak case. Bush left intact a $250,000 fine and two years probation for Libby, according to a senior White House official, who spoke on condition of anonymity because the decision had not been announced.

Bush's move came hours after a federal appeals panel ruled Libby could not delay his prison term in the CIA leak case.

Bush's statement:

I have said throughout this process that it would not be appropriate to comment or intervene in this case until Mr. Libby’s appeals have been exhausted. But with the denial of bail being upheld and incarceration imminent, I believe it is now important to react to that decision.

This case has generated significant commentary and debate. Critics of the investigation have argued that a special counsel should not have been appointed, nor should the investigation have been pursued after the Justice Department learned who leaked Ms. Plame’s name to columnist Robert Novak. Furthermore, the critics point out that neither Mr. Libby nor anyone else has been charged with violating the Intelligence Identities Protection Act or the Espionage Act, which were the original subjects of the investigation. Finally, critics say the punishment does not fit the crime: Mr. Libby was a first-time offender with years of exceptional public service and was handed a harsh sentence based in part on allegations never presented to the jury.

Others point out that a jury of citizens weighed all the evidence and listened to all the testimony and found Mr. Libby guilty of perjury and obstructing justice. They argue, correctly, that our entire system of justice relies on people telling the truth. And if a person does not tell the truth, particularly if he serves in government and holds the public trust, he must be held accountable. They say that had Mr. Libby only told the truth, he would have never been indicted in the first place.

Both critics and defenders of this investigation have made important points. I have made my own evaluation. In preparing for the decision I am announcing today, I have carefully weighed these arguments and the circumstances surrounding this case.

I respect the jury’s verdict. But I have concluded that the prison sentence given to Mr. Libby is excessive. Therefore, I am commuting the portion of Mr. Libby’s sentence that required him to spend thirty months in prison.

My decision to commute his prison sentence leaves in place a harsh punishment for Mr. Libby....

The Constitution gives the President the power of clemency to be used when he deems it to be warranted. It is my judgment that a commutation of the prison term in Mr. Libby’s case is an appropriate exercise of this power.

Our long national nightmare silly fantasia is over.

Suggestion: Bush should have reduced the fine to a more reasonable $50,000, which just so happens to be how much Sandy Berger was fined for stealing and destroying classified documents and lying about it to investigators (he wasn't charged for the latter, but subsequent revelations has made it clear he did just that).

Making the fine $50,000 would have been more in line with Libby's transgressions, and it would have made it harder for Democrats to argue against it. The penalty -- no jail time, $50,000, probation -- would have been so similar to Berger's that one could scarcely mention it without also mentioning Berger.

I think this sounds about right, especially if it leaves Scooter free to continue his appeals.

Plus, the DUmmies are inconsolable.  At least one has voiced a death wish against Bush.  Quite frankly, I'm surprised it's only been one so far.  Others are convinced that Bush is about to declare martial law and dissolve Congress.

I'd like to think W did this out of conviction.  But the fact remains that a whole bunch of us just demonstrated our ability to make Senators sweat, and if Libby spent a night in jail, then I suspect we might have made W sweat too, and  perhaps a lot worse.  Although I am fully aware that Libby is no saint, just a water-carrier, that man going to jail would have pushed me over the edge to buy that airline ticket to DC, and I suspect there were a lot of people who were right at that point.  If we let the bastards who already control the MSM and the universities start putting people in jail for what party they belong to, God knows where it will stop, so it has to stop right fucking now.

Hey all,
  Libby lied under oath.  He deserves to be in jail for his crime. Just because democrats get off easy from lying under oath and stealing national security documents does not mean than Libby should get off easy.  Bill Clinton and Sandy Burger should have done jail time.  We need to be consistent about these things and hold all public officials to a higher standard.

No, Libby was convicted of lying under oath in a highly suspect trial.  This commutation is consistant with the nature of the trial, Libby's life, and common outcomes in similar cases.  It also smartly leaves Libby's appeal of the conviction itself intact. Libby still has a chance to clear his name.

Bush is taking heat because the commutation was premature and, hence, unnecessary. Bush has the executive power; the POTUS administers the federal prisons. Therefore he could have delayed accepting Libby into the prison system until the appellate process had completely been played out.

71 For all those "commutation vs. pardon" debaters out there, I suspect that this outcome is exactly what was requested by the Libby team. Considering the many "foot in a bucket of cement, right hand tied behind back" rulings by the trial judge, along with the "12 experts say it's questionable" amicus brief about the initiation of this farce, there's still a significant chance of exoneration in a court of law. Their last, worst choice for an outcome would be a full pardon with an appeal that fails for being moot.

There's no chance that a quarter million is "moot", and that allows Scooter to pursue his case through the appeals process. If, after the election and before the inauguration, the case doesn't look solid, then would be the time to take a pardon.

I don't like fishing expeditions by special prosecutors, even when they convict people I don't like.  He didn't deserve to go to the pokey over all that Valerie Plame / Joe Wilson crap.  But, all this inside baseball stuff is a real bore.  Our government generally despises regular guys like us, as proved by their recent attempt to shove that amnesty bill down our throats.  Libby is no ally of conservatives, or friend of liberty.  He's just another amoral lawyer on the make.  He wouldn't give a damn about you or your problems, and I suggest that you shouldn't give a damn about his.

And what does it say about Dick Cheney that he had, as a close confidant, the mouthpiece for a fugitive creep like Marc Rich?
