"Volunteered" Stories Were False On "Day One" of Investigation
According to the military source, Beauchamp's recantation was volunteered on the first day of the military's investigation. So as Beauchamp was in Iraq signing an affidavit denying the truth of his stories, the New Republic was publishing a statement from him on its website on July 26, in which Beauchamp said, "I'm willing to stand by the entirety of my articles for the New Republic using my real name."The "ludicrous" Goldfarb/Michelle Malkin/Ace of Spades front ludicrously blundered into the ludicrous truth of the ludicrous matter.
I repeat: "Franklin Foer Doesn't Want To Tell Ellie Reeves Her Husband Is A Liar" Direct. Quote. From a TNR staffer. Never denied by TNR sources -- indeed, a TNR source wrote to Max Blumenthal slamming Gracie for eavesdropping on convesations. But not for fabricating them. Just for eavesdropping.

Actually there are no winners, Ace is vindicated, but the fact that this shit happened in the first place is a disgrace. Ace was in the lead correcting a false narattive, and can be proud of himself (and some of his source's and commenters) for that, but it's not really a win. It's just a correction of a shituation that never should have existed.

I didn't do a FRACTION of what this motherfucker did, and I became Merit PFC, Merit LCPL (again) and Merit Cpl, with a NAM, and STILL while reviewing my own S1 records (personell records) personell file, I saw that I wasn't listed as 1A. Actually, its easier and harder than just that. Easier in that you don't need to delete any clusters to actually eliminate hysteresis - overwriting with varying bit patterns will work fine.
Harder in that these days you have to account for write back caches to ensure the erasing patterns actually get committed. Windows has a file open mode that allows bypassing the cache, but there's still drives and caching controllers with onboard writeback caches that have to be dealt with. Usually a 5 second delay between passes with a file close op between passes will be good enough.
We had to do this with the Shuttle flight computers on the mil payload flights. In the early 80's the flight computers still had mag core memory which exhibited hysteresis effects. A program was written that wiped the core for hysteresis effects before the vehicle door was opened after landing.

In my experience (my best friend, since I was 6 years old, and Monty's Hang'm high attitude) the army is MUCH more official in their punishments than the Marines.
Oh, Marines go through more shit, but most of the time, Marines know that their mistakes are just mistakes (my only complaint about my CM isn't about me getting SCM'd, but rather than more than 50 pages, of a more than 100 page recommendation consisted of a non-event that didn't even involve me concerning someone I never met(someone thought I fucked his wife, I didn't someone I knew did) thats my only bitch. I got just about what I rated, though I think a batallion level NJP would have been more appropriate, but the SCM was close enough) so it's usually left to the NCO's, with the officers telling you, you should be thankful.
DoN in general is Less official in their punishments, compared to AF and Army. But this fucking dirtbag didn't just represent the Army in his dispatches, but ALL service.
He should be hit hard, hard hard hard hard.

Actually, the UCMJ is the blanket code, but all authority is attached to individual orders. The Marines have a more strict line of individual conduct, and "unbecoming a Marine" doesn't fall under the Unbecoming an officer and gentileman in the united states armed forces, but rather under the general article.
The UCMJ is Federal law, MCO's and division, regimental, batallion and even company orders apply as though they are a part of the UCMJ.
Though I don't think there is any requirement for non-NCO's to adhere to them, so the fact that the guy from the shitty movie "gladiator" (the one with brian denhie) likely wouldn't have been found guilty.
Biggest reason "A Few Good Men" is a bad movie, is that it makes Marines look like lunatics, megalomaniacs and retards, who outsmart DoN intelligence sources, has a serious issue with exactly how they view the finest fighting force ever formed in the history of the world.
What are we? Lunatics? Megalomaniacs? retards? brilliant people who know more than DoN Intel sources?

I was replying to what I saw was a question about whether the Army and USMC had different laws, not about the differences in prosecuting and/or handing out admin discipline in the two branches (well Department of Army vs Department of Navy because USMC still is attached to Navy's six as I like to remind my leatherneck friends). The sort of stories Beauchamp told were not new to anyone who's familiar with the literature of war, from Thucydides on down; as Jack Beeching wrote about the Battle of Lepanto, "There may be such a thing as a just war, but there's no such thing as an innocent army." But TNR presented Beauchamp's tales as the be-all and end-off of discussion about the war - as if the coarseness and mockery and petty atrocities were sum of what our army is accomplishing there. And that is the biggest lie of them all. Even if everything Beauchamp wrote were Gospel-true, it's true but fake.
Finally, I find myself pitying that sad sack of shit, Beauchamp. His remaining time in the Army is going to be unrelieved hell - and what could he expect, after he held his squad-mates up for public ridicule? Further, any hope he might have had for a career as a writer or journalist is stone-cold dead. And his marriage? She vouched for him and he humiliated her; it will take a very strong marriage to survive that.
No, I'm not going to be popping any champagne. Still, good work, Ace, in helping to exposing Beauchamp's work as the tissue of lies that it's proving to be.

Even with an admin, he could be looking at some serious shit.
That being said, there are things called involuntary administrative separations. Without knowing more of the specific facts of what specific order he may have violated, soldiers can be separated under ch 14-12c of AR 635-200 for commission of a serious offense (i.e. one warranting a punitive discharge if taken to trial).
Separation under 14-12c usually comes with an Other Than Honorable Discharge (the worst non-punitive discharge possible) and occassionally a General Discharge.
Administrative separations have a lower burden of proof (preponderance) than Article 15s or courts-martial (proof beyond reasonable doubt) and are often preferred when you want to get rid of a soldier without taking them to trial.

I disagree. It wasn't in the same class as Beauchamp, but Glass claiming that CPAC attendees had coke-fueled orgies didn't do campus conservatives any favors and made it very easy to discredit the movement.
Besides, there was no coke at any of the CPAC orgies I attended.

The circumstances of you service and discharge sound pretty difficult, to say the least. I was happy to get out after my 4 in the Nav w/an honorable and never regretted or looked back. Saw some decent people get screwed over though. Not a bunch, but enough to know that it can happen to anyone who runs afoul of the wrong person. And you're right, none of them did anything which approached what this pos Beauchamp has done. He'll walk, undoubtedly. But the most important thing is the guys he served with were able to retrieve their good names, as have we all who served, to a certain extent. That's the silver lining, from my pov.

Having been at one time a long-time TNR subscriber I can only shake my head in disgust (and shame) for what was at one time a great magazine.
Martin Peretz must similarly be disgusted by his editors and is no doubt lamenting the fall of TNR.
The truth is that the (hyper) partisan opponents of the POTUS and his party are willing to suffer any defeat as long as it leads to their regaining power.

When the Army investigators spoke with Beauchamp, they almost certainly had already interviewed at least those troops close to Beauchamp most likely to have direct knowledge of what did or did not happen. They may have already interviewed everyone else to find out what they knew or had heard. Good investigators never go into an interview cold, with no real knowledge that they can use to trip up a suspect. Bluffing a suspect is deadly. If he calls your bluff on anything, your credibility is shot, and you're dead in the water. Oh yes, and they would have isolated Beauchamp from the rest of the troops, and the troops from each other, before they began talking to anyone.
Unlike civilian police work, the military investigator does have certain advantages because of the substantial degree of control the military has over each soldier, however, even under the UCMJ, soldiers have rights, including 5th amendment rights against self incrimination. No doubt, the investigators informed Beauchamp of the relevant portions of the UCMJ and the relavant punishments he would likely suffer for the various potential offenses up front. They would not have yelled, jumped up and down, or in any way abused him, just calmly laid things out. Then they would have asked specific questions ("Where, exactly is the mass grave? Who was driving the Bradley? Who was with you when you abused the disfigured woman?"), and if they sensed any hesitation or evasion, reminded him, perhaps a bit more forcefully, of what he had to lose if he failed to tell the truth.
Remember that even in the military, Beauchamp could exercise his right to an attorney and refuse to answer any questions. Obviously, he did not, and the investigators got the truth.
How do we know it's the truth and not just Beauchamp trying to avoid punishment, or limit its severity? As other bloggers have pointed out, the punishment for lying to the investigators would have been far more severe than admitting to the misconduct Beauchamp alleged in his stories. His self interest lay in telling the truth, not continuing to lie. Also, he gave just enough details in his fables to make central facts, places, times, etc. in the stories checkable.
If the mass grave story was true, Beauchamp would have been able to lead investigators to the grave. He would have been able to name the skull-wearing troop and all of the others who witnessed his antics over many hours. If it was true, it would be impossible for all of those involved to engage in a successful coverup, even if they were of a mind to do that, which seems unlikely in this case.
The disfigured woman story was likewise checkable. If Beauchamp continued to claim that it occurred in Kuwait, that narrows things down, and the Army would have all the time and resources necessary to narrow it down as to date, time, and the roster of personnel present on that date and time. But what about Franklin Foer and the several anonymous sources who told him that it did occur and that it occurred in Kuwait? No doubt the investigators spoke with them and they quickly admitted that they were just trying to help out a buddy, a buddy who gave them a story to tell Foer to help muddy the waters a bit, and Beauchamp then confirmed their story--Beauchamp's lapse of memory--when asked by Foer. Foer, of course, was only too glad to accept it as a minor lapse of memory, easily explained, easily forgiven. Army investigators would not have been so forgiving.
Keep in mind that the investigators would have assured Beauchamp that if the stories were true, he would give them every detail, down to the millisecond, and they would check each and every detail. Knowing that, and the investigators would have been very convincing, is it more likely that Beauchamp would continue to blow smoke, or come clean?
And the Bradley driving incidents were also checkable. Remember that in order for that kind of behavior to be credible, a Bradley vehicle commander, an NCO, not only would have allowed it, but participated in it, many times. Again, specific places and times that could have been checked to reveal the damage to Iraqi private property. Iraqis not at all afraid about speaking up and getting the compensation that America commonly pays in such situations surely would have assisted. Again, too many people would have had to have been involved for everyone to engage in a massive coverup, particularly to assist one sad sack private.
The investigators got to the truth, and quickly, but they did so professionally, using good techniques, and they confirmed their findings with every other troop who could possibly know anything. Beauchamp lied. He wasn't bright, he didn't think anything through, and TNR was so anxious to depict the Army in a bad light, they bought what were obvious fabrications. All that remains is to see to what degree Foer and TNR Rather themselves into the ground.
